WHEREAS, Said creek is not navigable at low tide; there-
fore

SECTION 1. Be it enacted by the General Assembly of Mary-
land,
That the said Foster R. Cardwell, property owner and
taxpayer of Cecil County, Maryland, be and he is hereby au-
thorized and empowered to construct, maintain and operate,
at his own expense, a dam across Back Creek, in Elk Neck,
between Timber Neck and Thackery Point on the Elk River,
in Cecil County, Maryland, said dam to be constructed about
forty feet from the mouth of said Back Creek, and said dam
to be on the property of the said Foster R. Cardwell, to be
forty-two feet long and to vary in height from about six to
ten feet, the plans and specifications and erection thereof to
be subject to the approval of the Chief Engineer and Secretary
of War of the United States of America.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1939.

CHAPTER 245.
(House Bill 42)

AN ACT to add a new section to Article 51 of the Annotated
Code of Maryland (1935 Supplement), title "Juries", said
new section to be known as Section 25 and to follow imme-
diately after Section 24 of said Article, providing for
alternate jurors upon the request of either party or upon
the court's motion.

SECTION 1. Be it enacted by the General Assembly of Mary-
land,
That a new section be and it hereby is added to Article
51 of the Annotated Code of Maryland (1935 Supplement),
title "Juries", to be known as Section 25, to follow immediately
after Section 24, and to read as follows:

25. Whenever it appears that the trial of an action triable
by a jury is likely to be a protracted one, the court may, upon
the request of either party or upon its own motion, direct the
calling of one or two additional jurors, to be known as "Alter-
nate Jurors". Such jurors must be drawn from the same
source, and in the same manner, and have the same qualifica-
tions as the jurors already sworn, and be subjected to the same
