SEC. 16. And be it further enacted, That the said Mayor and
Commissioners of Cresaptown are hereby authorized and em-
powered at any time or times thereafter to enact an ordinance
or ordinances setting out the purpose or purposes for which
the money provided under this Act shall be applied, and the
approximate cost of each item of expenditure, and to submit
the same to the qualified voters of said town of Cresaptown
at an election, and said election shall be held under the super-
vision and direction of the said Mayor and Commissioners of
Cresaptown and in the manner in which the general elections
of the said town are held, and such ordinance shall not be
effective unless a majority of the votes cast at such an election
shall declare the assent of the voters to the borrowing of said
money and the issuing of said bonds mentioned in said ordi-
nance, and to the purposes to which said money shall be
applied.

The ordinance or ordinances, mentioned in this section, shall
clearly set forth the amount of the bonds which the Mayor
and Commissioners of Cresaptown desire to issue, a general
description of the purposes or improvements to which the
money is to be applied, and an estimate of the approximate
costs in carrying out such improvements; and the issuance of
bonds under this Act may be submitted by the Mayor and
Commissioners of Cresaptown to the qualified voters by ordi-
nance, as herein provided for, at any time and from time to
time, until the full amount of one hundred thousand dollars
($100, 000) as herein provided for shall be authorized, and the
Mayor and Commissioners of Cresaptown may, if they desire,
incorporate in said ordinance two or more distinct proposi-
tions and submit the same to the voters so as to allow them
to vote for either or all of said propositions.

SEC. 17. And be it further enacted, That for the purpose of
determining whether the citizens of said Cresaptown desire
to incorporate, there shall be held a referendum on June 15,
1939, between the hours of 7 A. M. and 7 P. M. under the
supervision of a committee consisting of Jacob Richardson,
Francis Keefer and Wm. Meagher who are hereby appointed
judges for that purpose and for the time hereinafter named;
provided that in case any of said judges shall be unable to
act on account of sickness, death, refusal to act or otherwise,
then the remaining judge or judges shall fill the vacancy or
vacancies by appointing a suitable person or persons residing
in said town who are qualified voters therein in accordance
with the provisions of this Act.

The said committee shall not less than five days before said
referendum election, post in five conspicuous places in said
town a written or printed notice notifying all the residents
