34. Where the engineer or surveyor or his representatives
entering on private property for the purposes stated in Sec-
tion 32 of this Act, shall tender damages to owner of said
property and said proffer is not accepted, and the amount of
damages determined according to procedure stated in Section
33 of this Act, shall not exceed amount of damages so proffered,
then all costs in the matter shall be borne by the owner of
the property, otherwise the cost shall be assessed against the
party entering.

35. If any person shall wilfully injure, deface or destroy
the mark or monument at any survey station established by
or under the direction of the United States Coast and Geodetic
Survey, or the State department administering the Maryland
Coordinate System, or by any other organization whose survey
stations have been established by or in accordance with the
requirements of the State department authorized to administer
the Maryland Coordinate System, or by any other State,
Municipal or County agency, or shall offer any obstacles to
the proper, reasonable, and legal use of any such station, such
person shall be guilty of a misdemeanor, and, upon conviction
thereof, shall be sentenced to pay a fine not to exceed two
hundred and fifty dollars for each offense and costs, or shall
be imprisoned for a term of not less than six months, or both,
in the discretion of the court.

Bureau of Control Surveys and Maps.

36. That a Bureau of Control Surveys and Maps be estab-
lished in the Department of Public Works whose functions
will be to administer the laws relating to the Maryland Co-
ordinate System; to extend this system in Maryland and to
take over the duties of the present Maryland Mapping Agency
and extend its activities.

37. The activities of the Bureau of Control Surveys and
Maps shall be determined by an Advisory Board, consisting of
the Chief Engineer of the State Roads Commission of Mary-
land, the Chairman of the State Planning Commission and the
Dean of the College of Engineering of the University of Mary-
land. The members of this Board shall serve without com-
pensation, except that they shall be reimbursed for their
necessary traveling expenses.

38. The Advisory Board of the Bureau of Control Surveys
and Maps shall determine the best location for the establish-
ment of the office of this Bureau.

39. In carrying out the functions of the present Maryland
Mapping Agency the Bureau of Control Surveys and Maps
