absence of the City Purchasing Agent due to illness, vacation
or otherwise.

SEC. 2. And be it further enacted, That should any section,
part, paragraph, sentence or phrase of this Act be declared in-
valid, for any reason by any court having jurisdiction, such
declaration shall not affect the remainder of this Act, but the
same shall remain in full force and effect as if the invalid sec-
tion, part, paragraph, sentence or phrase had not been enacted.

SEC. 3. And be it further enacted, That all laws or parts of
laws, whether Public Local or Public General inconsistent with
any provision of this Act, be and the same are hereby repealed
to the extent of such inconsistency.

SEC. 4. And be it further enacted, That this Act shall take
effect June 1, 1939.

CHAPTER 601.
(House Bill 759)

AN ACT to repeal and re-enact with amendments Section 409
of Article 1. 2 of the Code of Public Local Laws of Maryland
(1930 Edition), title "Garrett County", sub-title "Oakland",
setting forth the duties and qualifications for Mayor of the
Town of Oakland.

SECTION 1. Be it enacted by the General Assembly of Mary-
land,
That Section 409 of Article 12 of the Code of Public
Local Laws of Maryland (1930 Edition), title "Garrett Coun-
ty", sub-title "Oakland", be hereby repealed and re-enacted
as follows:

409. No person shall be eligible to the office of Mayor un-
less lie shall have attained the age of thirty years, and shall
have resided two years next preceding his election in said
town, and shall be a freeholder in said town of Oakland. The
Mayor elected at any regular election shall hold office for two
years from the first Monday in April next after his election
and until after his successor is elected and qualified. Should
a vacancy occur in the office of Mayor by reason or removal
from town, removal from office, death, resignation or other-
wise, the president of the council shall perform all the duties
