prior thereto. As to estates created by the exercise of a power
of appointment, the date of such exercise, and not the effec-
tive date of the instrument creating such power, shall be the
date of creation for this purpose.
SEC. 2. And be it further enacted, That all laws or parts
of laws inconsistent with this Act are hereby repealed to the
extent of such inconsistency; and that this Act shall become
effective on June 1, 1939.

CHAPTER 581.
(House Bill 357)
AN ACT to repeal Section 305C of Article 93 of the Code of
Public General Laws of Maryland, as heretofore enacted by
Chapter 495 of the Acts of 1929; relating to the apportion-
ment of rents, annuities, dividends and periodical payments.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 305C of Article 93 of the Code of Public
General Laws of Maryland, heretofore first enacted by Chapter
495 of the Acts of 1929, be and the same is hereby repealed;
provided, however, that the provisions of Section 305C of Arti-
cle 93 of the Code of Public General Laws of Maryland, as
heretofore enacted by Chapter 495 of the Acts of 1929 shall
remain in full force and effect as to successive estates or
interests created by deed or other non-testamentary act, effec-
tive between June 1, 1929, and June 1, 1939, and as to Wills of
Testators dying between June 1, 1929, and June 1, 1939.
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1939.
