and any person or persons convicted before a justice of the
peace under the provisions of this Section, shall have the right
of an appeal within ten days to the Circuit Court for Wash-
ington County, and shall be held by recognizance or be com-
mitted to the County Jail to appear before the next regular
jury term of the Circuit Court for Washington County.

SEC. 10. And be it further enacted, That the said Burgess
and Council are authorized to fix rates for the use and con-
sumption of water supplied for any purpose, and may, in their
discretion, place meters or other appliances for the purpose of
measuring the water used by consumers and make a rate or
charge therefor accordingly, and all sums of money which may
become due and owing to the town of Boonsboro as will ap-
pear from the books of said town from time to time, for water
rentals or services, shall be and constitute a lien upon the real
property to, in or upon which such water service is supplied.

SEC. 11. And he it further enacted, That the Burgess and
Council are hereby authorized and empowered to do all acts
necessary and proper to carry out the provisions of this Act,
whether such powers are specially herein mentioned or not,
and to pass any and all ordinances necessary for the carrying
out of the provisions of this Act.

SEC. 12. And be it further enacted, That the said Burgess
and Council are authorized to provide by ordinance for the
protection of the said water works, pipes, hydrants, fire plugs
or other parts thereof, and to provide penalties for any vio-
lation of such ordinance not inconsistent with the provisions of
the existing charter of the said town of Boonsboro.

SEC. 13. And be it further enacted, That the said Burgess
and Council of Boonsboro, before issuing any bonds here-
under, shall first, at a special or regular municipal election,
submit to the voters of Boonsboro the question whether or not
said bonds shall be issued, and upon the ballots to be used at
said election, there shall be printed or written the words, "For
Water Bonds", and "Against Water Bonds", and if a majority
of the votes cast upon said question shall be "For Water
Bonds", then the said Burgess and Council shall exercise the
powers vested in them by this Act and shall issue the bonds
authorized by this Act; but if the majority of the votes cast
upon said question shall be, "Against Water Bonds", the
power shall not be exercised, nor the bonds issued, but the said
Burgess and Council, however, are hereby authorized to sub-
mit the same question to the qualified voters of Boonsboro
at the next general election held in said Boonsboro, or at any
