378 of the Acts of Assembly of 1922 and still outstanding and
seventeen hundred and fifty dollars ($1, 750) of the bonds au-
thorized by Chapter 208 of the Acts of Assembly of 1927 and
still outstanding, and the remaining part of the fund herein
provided for shall be available for the further improvement of
the streets of the said town of Kitzmillersville.

SEC. 5. And be it further enacted, That for the purposes of
retiring the said bonds authorized to be issued by this Act, and
the payment of the interest thereon, there shall be levied against
all the assessable property within the corporate limits of the said,
town of Kitzmillersville by the Mayor and Council of said town
annually, so long as any of said bonds are outstanding and un-
paid, a tax sufficient to meet the interest, or any part of said
interest, on said bonds as it becomes due, and to pay the princi-
pal thereof as they mature, said tax to be determined, levied,,
collected and paid over in the same manner as provided for other
taxes in said municipality.

SEC. 6. And Be it further enacted, That on the first Tuesday
in May, 1931, there shall be a special election held in the town
of Kitzmillersville, which election shall be held in the same man-
ner and under the same regulations as other municipal elections;
held in said town, for the purpose of submitting the question as
to whether or not this Act shall take effect, to all legal voters
of said town who are qualified to vote at a regular town elec-
tion, and all ballots at said election shall have printed on them
the words following, to wit: "For Refunding and Improve-
ment Bonds'7 and "Against Refunding and Improvement
Bonds, 7? and the qualified voters of said town desiring to vote*
on said question at said election shall indicate their choice of
said propositions by making a cross-mark opposite the proposi-
tion for which they desire to register their votes, and if a ma-
jority of the votes so cast are marked "For Refunding and Im-
provement Bonds, " then this Act shall be in full force and
effect, otherwise shall be null and void and of no effect. The
judges of election shall, under their hands and seals, immedi-
ately after said election certify to the Mayor and Council of
Kitzmillersville the result of said election.

SEC. 7. And Be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and having
been passed by a yea and nay vote, supported by three-fifths
of all the members elected to each of the two Houses of the
General Assembly, the same shall take effect from the date of
its passage.
