CHAPTER 161.
AN ACT to repeal and re-enact with amendments Sections 2,
5, 10, 11, 13, 15, 31, 33 and 38 of Article 65 of. the Annotated
Code of Maryland (1924 Edition), title ''Militia, '' making
certain changes in tie law relating to the Organized Militia
of the State.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 2, 5, 10, 11, 13, 15, 31, 33 and 38 of Article
65 of. the Annotated Code of Maryland (1924 Edition), title
"Militia, " be and they are hereby repealed and re-enacted with
amendments, to read as follows:
2. When the militia of this State, or any part thereof, is
called or ordered under the Constitution and laws of the United
States, into the active military service of the United States, the
Governor shall order out for service the Organized Militia, or
such part thereof as may be necessary and if the number avail-
able be insufficient he shall order out such part of the unor-
ganized militia as he may deem necessary.
5. The militia of this State shall be divided into two classes:
the organized militia and the unorganized militia. The organized
militia shall consist of the regularly enlisted members of the
militia, and such other persons between the ages of forty-five
and sixty-four as are authorized to enlist therein by the Gov-
ernor, organized, armed and equipped, and of commissioned offi-
cers between the ages of twenty-one and sixty-four; provided,
that a military office for which no salary is provided in the
Budget, is not an office of profit. The unorganized militia shall
consist of all those liable to serve but not regularly enlisted.
10. The Banking Line Officer shall be on active duty status
and his salary shall be as stated in the annual budget; provided,
that should the Ranking Line Officer be also appointed the Ad-
jutant General, he shall receive only the salary provided by law
for the Ranking Line Officer; and provided further, that, should
the Ranking Line Officer be called or ordered into the active
military service of the United States, under the Constitution
and laws of the United States, the Governor may designate an
acting Ranking Line Officer, who will exercise all the duties
of the office during such period.
The Ranking Line Officer shall be in control of. the military de-
partment of the State, and subordinate only. to the Governor in
matters (pertaining to said department. He shall keep in his
office all records and papers required to be kept and filed there-
