CHAPTER 106.
AN ACT to repeal and re-enact, with amendments, Sections
428, 429, 430, 431, 432, 433 and 434 of Article 16 of the
Code of Public Local Laws of Maryland, title "Montgomery
County, " sub-title "Garrett Park, " as same were enacted by
Chapter 790 of the Acts of the General Assembly of Mary-
land, 1912.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 428, 429, 430, 431, 432, 433 and 434
of Article 16 of the Code of Public Local Laws of Maryland,
title "Montgomery County, " sub-title "Garrett Park, " as the
same were enacted by Chapter 790 of the Acts of the General
Assembly of Maryland, 1912, be and the same are hereby re-
pealed and re-enacted, with amendments, to read as follows:
428. Prior to the beginning of each fiscal year the council
shall prepare and adopt an annual budget covering the esti-
mated receipts and disbursements of the revenues of the town
for the fiscal year beginning July first following its adoption.
Said budget shall include a carefully prepared and itemized
estimate of town revenues from all known sources, including
any balance unexpended from the previous year. Against the
total revenues, including any balance unexpended from the
previous year, thus estimated the council shall apportion such
sums as, in its judgment, may be necessary and proper to meet
the various estimated requirements of the town during the said
fiscal year, as far as such requirements can be estimated; pro-
vided, however, that the total of such proposed expenditures
shall not exceed ninety per cent, of the estimated revenues of
the town, including any balance unexpended from the previous
year, the remaining ten per cent, of said estimated revenues to
be maintained as a reserve to meet extraordinary or unantici-
pated expenditures as the council may direct. No item of
budget allotments shall be exceeded except by authority of the
council, who shall make provision for any extra requirements
without exceeding the total amount of estimated budget re-
ceipts.
On or before the 15th day of April in each year the council
shall cause an assessment to be made of all the real and/or
personal property within said town or the corporate limits
thereof by an assessor or assessors to be appointed and paid by
the council, which assessment of any particular property shall
