scribe to the oath, which shall be certified to and recorded
among the records of the Mayor and Council.

RECALL.

122B. The holder of any elective office created herein may
be removed at any time by the registered voters of said town
qualified to vote for his successor by the use of the following
procedure: A petition signed by not less than 50 per cent, of
the voters, entitled to vote for a successor to the officer sought
to be removed, setting forth that the officer in question has
failed to perform the duties of his office in a manner desired
by the petitioners, and. specifying the instances of such failure,
and demanding an election for the purpose of selecting a suc-
cessor, shall be filed with the Mayor and Council at the regu-
lar stated meeting.

The Mayor and Council immediately upon the receipt of
such petition shall pass upon the legal sufficiency thereof; for
the purpose of determining whether the requisite number of
duly qualified voters have signed the same, they shall refer said
petition to the Supervisors of Election who shall report there-
on in writing.

If the petition shall be found to be legally sufficient, the
Mayor and Council shall immediately order an election for
the purpose of electing a successor to said officer. The Super-
visors of Election shall thereupon proceed to fix a date for
said election, and shall give at least ten days' notice thereof
in the same manner as they are required to give notice of regu-
lar elections.

The officer elected at such election shall hold office only for
the unexpired term of his predecessor.

122C. The Mayor and Council shall have the authority
from time to time to create, fill and discontinue all offices and
employments other than herein prescribed, according to their
judgment of the needs and requirements of the town; and in
their discretion, by a majority vote of all the members of the
Mayor and Council, to remove for or without cause the in-
cumbent of any such office or employment, and may, by order
or otherwise, prescribe, limit or change the compensation and
duties of such officer or employees.

The Mayor and Council shall have the power to remove any
officer for incompetency, corruption, misconduct, malfeasance,
misfeasance or nonfeasance in office, or for such other causes
