Ocean City in said Worcester County, to connect the Atlantic
Ocean with the Sinepuxent Bay, together with such jetties,
approaches,, channels and appurtenances as may be necessary
or convenient for the purpose aforesaid. The Governor, the
Comptroller of the% Treasury and the Treasurer, constituting
the Board of Public Works, or a majority of its members,
shall be fully authorized to direct payment to the Government
of the United States, or any agency thereof which may under-
take the acquisition of the necessary property and the con-
struction of the canal or inlet, jetties, approaches and appur-
tenances above referred to, of such portion of the proceeds of
said loan as may be necessary to cover not exceeding two-thirds
of the cost of the improvements above described, such pay-
ment to be made at such time or times, and in such install-
ments as the Board of Public Works, or a majority of its
members, may deem necessary to secure the completion of said
improvements; provided, however, that the Governor, the
Comptroller of the Treasury and the Treasurer, constituting
the Board of Public Works, or a majority of its members,
shall not be required to issue all of the certificates of indebted-
ness authorized by this Act, but the said Board or a majority
of its members, shall be fully authorized to issue such portion
of said certificates of indebtedness as the said board or a
majority of its members may deem necessary, in order to pro-
vide for1 not exceeding two-thirds of the entire cost of secur-
ing the necessary property and the construction of the im-
provements above described, and provided further, that no
part of said loan shall be issued, and no part of the proceeds
shall be paid over to the Government of the United States,
or any agency thereof, until the Government of the United
States shall have made provisions to pay at least one-third
of the cost, and for the completion, of the improvements above
described.
SEC. 7. And be it further enacted, That the Governor, the
Comptroller of the Treasury and the Treasurer, constituting
the Board of Public Works, or a majority of its members,
shall have full power to acquire by purchase, gift, condemna-
tion or otherwise, all lands, roads, approaches, rights and ease-
ments belonging to any person or corporation, that may be
necessary or convenient for the construction of the canal or
inlet, jetties, approaches and appurtenances above described,
the purchase price or cost of condemnation to be paid out of
the proceeds of the loan authorized by this Act, and to be
