11.    That the County Commissioners resident in the County
Commissioner District in which any public improvement auth-
orized in the preceding section is contemplated, is hereby auth-
orized and directed to conduct on behalf of the Board of County
Commissioners, the hearings specified in the preceding section
and all of the duties imposed by this Act upon the Board of
County Commissioners shall be performed by the said board
only after consideration of the recommendation of the County
Commissioner in whose district the duty is to be performed or
the improvement is to be made.

12.    That as soon as may be after the passage of this Act,
the Board of County Commissioners shall divide all property
within the Montgomery County Suburban District into one of
the four following classes: (1) Agricultural, (2) Undeveloped,
(3) Residential, whether improved or unimproved, and (4)
Industrial or Business. Property classified as (1) Agricul-
tural and property classified as (2) Undeveloped shall not be
assessed for tax purposes under the provisions of this Act, so
long as it remains so classified. Within thirty days prior to
making the next annual tax levy under this Act, the Board of
County Commissioners shall give notice of its intention to clas-
sify property as herein provided and their hearings as may be
necessary to afford every owner of proposed classification. And
within thirty days prior to making succeeding annual levies
under this Act the Board of County Commissioners shall give
notice of its intention to reclassify any property which in its
judgment should be reclassified and shall hold at least one
hearing before such change in classification is made. With
respect to both the original classification and reclassification of
property as herein provided, the required notice shall be given
and the required hearings shall be held in the same manner
prescribed in Section 10 of this Act.

13.    That every Act or omission designated as a misdemeanor
in this Act, unless otherwise provided, shall be punishable be-
fore the Circuit Court of Montgomery County or the police
justice at Rockville, and the offender shall, upon conviction,
be subject to a fine not exceeding one hundred ($100) dollars
or thirty days in the county jail, or both, in the discretion of
the court. Where such an act or omission is of a continuing
nature or is persisted in violation of the provisions of this Act
or of any ordinance, rule or regulation promulgated thereunder,
a conviction for one offense shall not, be a bar to a conviction
