(I) That, upon the closing of the polls, said Board of
Election Supervisors shall count the votes and publicly
announce the result of such election.

(J) That, within one (1) week after publicly announc-
ing the result of such election, said Board of Election
Supervisors shall make a certificate, to be sworn to by each
member of said Board before a Justice of the Peace, or
other officer or person, (including a Notary Public), au-
thorized to administer oaths in Prince George's County,
stating the result of such election, and the number of votes
cast for, and the number of votes cast against, incorpora-
tion. One such certificate, or a certified copy thereof, shall
be filed by said Board of Election Supervisors with the Sec-
retary of the State of Maryland, and another such certifi-
cate, or a certified copy thereof, shall be filed by said Board
among the records of said town, (in the event that this
Charter is adopted). Failure on the part of said Board of
Election Supervisors to make or file such certificate shall
in no wise affect the validity of such election.

(K) That if in such election a greater number of per-
sons shall vote "FOR INCORPORATION" than shall vote
"AGAINST INCORPORATION, " this Charter shall be-
come immediately effective and operative.

SEC. 12. And be it further enacted:

(A) That immediately upon this Charter becoming
effective, as provided in Section 11 of this Act, Messrs.
Gurney I. Hightower, Thaddeus C. Berry and Newton B.
Mantz shall constitute and be the District Heights Com-
mission until their successors shall have been chosen as
provided in Section 10 of this Act, and shall have qualified
as provided in Paragraph J of Section 3 of this Act.

(B) That, within ten (10) days, (including Sundays
and Holidays), after this Charter becomes effective, as
provided in Section 11 of this Act, each of the three Com-
missioners named in Paragraph A of this Section shall
qualify as such Commissioners by taking the oath of of-
fice of Commissioner, as provided in Paragraph J of Sec-
tion 3 of this Act.

(C) That if any person named as Commissioner in
Paragraph A of this Section shall fail to qualify as pro-
vided in Paragraph B of this Section, or in case a V£-
cancy in the office of Commissioner shall exist or occur as
a result of death, resignation or otherwise, the remaining
