Heights for improving, maintaining and repairing the roads,
streets, lanes and alleys in said town.

SEC. 16. And be it further enacted, That said members of
said Board of Commissioners of Fairmount Heights, for the
purpose of making contracts or otherwise incurring liabilities
in the performance of the duties provided by this Act, shall
be considered in law as a corporation, and are not to be held
individually or personally liable in connection therewith.

SEC. 17. And be it further enacted, That the Treasurer
of said Commissioners of Fairmount Heights shall deposit all
funds coming into his hands as such, together with all in-
terest accruing thereon, in such depository or depositories as
directed by a majority of the said Commissioners, to his
credit as such Treasurer, and that the Treasurer of said Com-
missioners shall not dispose of any of the funds coming into
his hands as such Treasurer, except upon check duly signed
by him as Treasurer, and countersigned by the chairman of
said Board of Commissioners, or some member thereof act-
ing as chairman. Such acting chairman shall be duly au-
thorized to act by resolution of said Board of Commissioners
which must first be placed upon the minute book of the Board
of Commissioners.

SEC. 18. And be it further enacted, That for the pur-
poses of determining whether the citizens of said Fairmount
Heights desire to incorporate there shall be held an election
on the second Tuesday in June, 1929, under the supervision of
the committee hereinafter named, the manner and procedure of
which shall be as follows:

The committee to conduct such election shall consist of
Charles W. Hawkins, George Patterson and Isaiah Miles as
judges of election, and Robert Palmer and Richard Johnson,
as clerks; and if any of said committee are unable or decline
to serve, the remaining members of said committee are em-
powered to select some resident voter of said town to fill his
place.

The qualifications of voters on the referendum election
shall be the same as those hereinbefore set forth in regard to
general elections.

The said committee shall, not less than five days before
said referendum election, post in five conspicuous places in
