(j) The sum of $5, 000. 00 for the constructing, building,
equipping and furnishing a colored school at Hagerstown.

(k) And the sum of $62, 425. 00 for the purchase, acquir-
ing or condemning of sites whereon to erect the aforesaid
school buildings, exclusive of the Clearspring building, for
which a site has already been provided.

Provided, however, that the funds herein enumerated and
for the specified purposes herein outlined shall be expended as
herein set forth and shall not be diverted for any other purpose
except upon approval by the Board of County Commissioners
of Washington County, and any balance remaining unexpend-
ed of the amounts hereinbefore specified shall be retained by
the County Commissioners of Washington County and applied
by them in their discretion to school purposes.

SEC. 5. And be it further enacted, That the said Board
of Education of Washington County shall award the contracts
for the erection of said school buildings, provided for in this
Act, equipping the same with heating plants and lighting and
water fixtures, to the lowest responsible bidders therefor, re-
spectively, after the said Board shall have advertised for bids
therefor, provided, however, that said Board shall have the
right to reject any or all bids. Said Board of Education shall
require the successful bidder or bidders to whom said con-
tracts, or any of them, are awarded, to make a contract in writ-
ing for the faithful performance of his or their work, and
said contractor or contractors shall agree in said contracts to
pay all laborers employed by him or them, on said buildings,
and for all materials used in the construction and equipping
of the same, and shall give bond, acceptable to said Board, for
the faithful performance of his or their contract. The said
Board of Education is hereby given full power and authority
to employ an architect or architects and to do all things in
connection with the construction and equipping of said build-
ings as may be necessary.

SEC. 6. And be it further enacted, That if and whenever
the said Board of Education shall determine upon the erec-
tion of either or any of the public school buildings designated
in Section 4 hereof, and shall let the contract or contracts there-
for as provided in Section 5 hereof, and shall desire that the
work of the erection of said building or buildings shall be
commenced and carried forward before it shall be possible to
