CHAPTER 125.
AN ACT to add a new section to Article 91 of the Annotated
Code of Maryland (Edition of 1924), title "Surveyor and
State Survey, " sub-title aPublic Roads, " said new section
to follow immediately after Section 28 of said Article and
to be known as Section 28A of said Article, to give the State
Roads Commission authority in all cases in which the said
Commission seeks to acquire property by condemnation pro-
ceedings under Sections 203 to 209, inclusive, or Sections
331-337, inclusive, of Article 23 of the Annotated Code of
Maryland (Edition of 1924) where any owner or owners of
the property sought to be condemned is or are not known,
to describe such owners as the unknown owner or owners
or the unknown heir or heirs, and to provide the effect to be
given to such notice by publication.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That a new section be and the same is hereby, added
to Article 91 of the Annotated Code of Maryland (Edition of
1924), title "Surveyor and State Survey, " sub-title "Public
Roads, " said new section to follow immediately after Section
28 of said Article, to be known as Section 28A, and to read as
follows:
28A. In all proceedings in which the State Roads Com-
mission seeks to obtain property by condemnation under Sec-
tions 203 to 209, inclusive, or Sections 331 to 337, inclusive,
of Article 23 of the Annotated Code of Maryland (Edition of
1924) where any owner or owners is or are not known, it shall
be lawful to describe such owner or owners as the unknown
owner or owners, or the unknown-heir or heirs of a deceased
owner, and notice shall be given to such unknown persons by
publication as notice is provided for in the case of non-resi-
dents in Section 204 of Article 23 of the Annotated Code of
Maryland (Edition of 1924); and when such notice is given
by publication, it shall have the same effect as if the said
unknown owner or owners had personally appeared and an-
swered in the said condemnation proceedings.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and having
