1440 VETOES.

I am, however, advised by the State Roads Commission that
the road from the Confederate Monument to Point Lookout is
now in good condition, and will be taken over and maintained
by the Commission, and that they will arrange in the near fu-
ture to construct the road from the Confederate Monument to
Scotland Beach from their general funds.

(Chapter 283, House Bill 376)

This bill directs the State Roads Commission to take over
and maintain the bridge over Tuckahoe Creek on the road
leading from Denton to Easton on the boundary between Tal-
bot and Caroline Counties.

This bridge is on an unimproved county road about half way
between Denton and Easton. There is approximately six
miles of unimproved county road on the Caroline side of the
bridge, and approximately five miles of unimproved county
road on the Talbot side. I can see no reason why a bridge
should be taken over to the State when there is no State road
leading to it from either side. When these county roads are
made State roads, and are completed as such up to the bridge,
then the bridge will be taken over by the State.

This bill will be vetoed.

EMPLOYMENT BY RACE TRACKS OF PERSONS
NOT CITIZENS OF THE UNITED STATES.

(Chapter 540, Senate Bill 390)

This bill prohibits the employment at any of the race tracks
in the State of persons who are not citizens of the United
States, except jockeys, trainers, managers, ticketroom men,
sheet writers and calculators. The bill is admittedly aimed at
Canadian citizens who customarily work at many of the race
tracks in the country, including those in Maryland.

Personally, I favor the employment of Maryland men at
the Maryland tracks to the full extent that this is practicable,
but I cannot approve Senate Bill 390, because it clearly vio-
lates the Federal Constitution. It is in conflict with the 14th
Amendment, which guarantees the equal protection of the laws.
This has been decided by the Supreme Court of the United
States in similar cases, Truax vs. Reich, 239 II. S. 33; Yick
Wo vs. Hopkins, 118 U. S. 356; Meyer vs. Nebraska, 262:
U. S. 390.
