EDWARD LLOYD, ESQUIRE, GOVERNOR. NOVEMBER.

1809.

II. AND BE IT ENACTED, That from and after the first day of March next, two days in each
week shall be held as market-days within the town of William's Port aforesaid, to wit: Wednesdays
and Saturdays, and victuals and provisions brought to the said town for sale, except beef by the
quarter or large quantity, and pork by the hog or hogs, upon these or any other days, shall be car-
ried to the public market-house of the said town, there to be sold to the inhabitants at the stated
market-house appointed by the said commissioners as herein directed.

III. AND BE IT ENACTED, That the said commissioners are hereby empowered to ascertain and
fix upon a proper hour or time to open the said market; provided, that one month's notice thereof
be given, by advertisement, set up at the market-house, and such notice be also published the same
length of time in the English and German news-papers printed in Hagar's-town, before any person
or persons shall be effected by the same, and the clerk of the market shall also give notice of the
commencement thereof, each market-day, by ringing the market-house bell for five minutes next be-
fore the time, and any person or persons who shall buy or sell any provisions or other article brought
to the said market for sale, (except as excepted in the second section of this act, ) before the ringing
of the bell shall be over, shall forfeit respectively for the same the sum of ten shillings current mo-
ney for each offence.

IV. AND BE IT ENACTED, That the commissioners of the town of William's Port, or a majority
of them, be and are hereby invested with sufficient powers, and it is hereby declared to be their du-
ty, to let the stalls and stands in or about the said market-house in said town to butchers or others,
at the best yearly rent that can be got for the same, taking security for the payment thereof, and to
compel payment therefor, and to apply such rents, together with all fines and forfeitures which shall
be incurred by virtue of this act, towards paying the clerk of the said market a salary, not exceed-
ing twenty pounds per annum, to be ascertained by a majority of the said commissioners, for the
faithful performance of his duty, and to apply the residue, if any, in repairing the said market-
house.

V. AND BE IT ENACTED, That if any person appointed commissioner by this act shall die, re-
fuse, or otherwise be rendered incapable to discharge the duties enjoined by this act, that the jus-
tices of the levy court of Washington county may nominate and appoint some person or persons in
his or their place, so as to make the number of five commissioners as aforesaid, and that com-
missioners, so appointed, shall have the same powers as the commissioners appointed by this
act.

VI. AND BE IT ENACTED, That George Saunders be and he is hereby appointed clerk of the
said market for one year from the first of March next; provided nevertheless, that in case of the
death, resignation, or refusal to act, of the said George Saunders, a suitable person shall be appoint-
ed as clerk of the said market, by a majority of the said commissioners, who are hereby likewise vest-
ed with power and authority to remove the said George Saunders for misconduct or neglect of
duty.

VII. AND BE IT ENACTED, That from and after the first day of March, one thousand eight
hundred and eleven, the clerk of said market shall be appointed annually by a majority of the said
commissioners, and shall be removable by them for misconduct or neglect of duty, and it shall be the
duty of said clerk to take the possession, care and charge, of the market and market-house aforesaid,
during his continuance in office, and to inspect all provisions brought thereto for sale, to try the
Weights and measures used at the said market by standards, if any be provided, and kept there by
said commissioners of said market for that purpose, and the same, when false or untrue, to seize,
and dispose to the highest bidder, and also to try, by standard, the weight of butter, and such other
articles of provision as are generally brought to market made up at a stated weight, and if they shall
be found deficient in weight, unsound or unwholesome, to seize and sell the same to the highest bid-
der, and to pay the money arising from every such sale to the commissioners, who shall dispose of
the same as herein directed.

VIII. AND BE IT ENACTED, That the clerk of the said market, (unless prevented by sickness, or
other unavoidable account or necessity, ) shall, and he is hereby required, to attend the said market,
at such hours as the commissioners may appoint at the different seasons, and if such clerk shall ne-
glect or repair to attend as aforesaid, he shall, for every such offence, forfeit and pay the sum of five
shillings current money, to be recovered by the commissioners of said market for the time being,
before any justice of the peace for Washington county, to be paid and applied as by this act di-
rected,.
