cedure established in this Act or under the general law
authorizing condemnation by corporation in this State, and
to exercise said right of condemnation over the right of con-
demnation of any of said corporations, and to condemn any
and all property of the Chesapeake and Ohio Canal Com-
pany; to assess one-half of the cost of said flood prevention
plan or plans against the property benefited, and to assess the
balance of said cost generally against all the property in said
City of Cumberland, to police and otherwise protect the work
done under this Act, and to prohibit the placing of any sub-
stance or obstruction in Will's Creek or the Potomac River,
and to provide penalties for the violation of these provisions,
to acquire land or rights in land in West Virginia, and to
hold stock in corporations holding land or rights in land in
West Virginia, and to form corporations for this purpose,
to appoint commissions and commissioners for the purpose
of carrying out certain of the provisions of this Act, and to
provide for the compensation of said commissioners, to pro-
vide for appeals from the action of the Mayor and City Coun-
cil of Cumberland in establishing said Will's Creek Flood
District, in condemning land under the special procedure
established herein, and in filing liens under the provisions
of this Act, to provide for carrying out the provisions of this
Act by orders or ordinances, limiting the jurisdiction under
this Act to the present limits of the City of Cumberland, and
for a mile in any direction outside of said limits, within the
State of Maryland, to provide certain rules of construction
in interpreting this Act, repealing all Acts or parts of Acts
inconsistent herewith, and providing that each section of this
Act and every part thereof shall be independent sections and
unaffected by the invalidity of any other part thereof.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Mayor and City Council of Cumberland
be and they are hereby vested with jurisdiction, power and
authority to establish as hereinafter provided a Will's Creek
Flood District, which may be entirely within or partly within
and partly without the corporate limits of the said City of
Cumberland as now located or as may be hereafter located,
and said Mayor and City Council are hereby authorized to
do all or any of the things and acts hereinafter mentioned
for the purposes of preventing floors, and of lessening the
danger and damage incident to floods in said Will's Creek
