CHAPTER 473.

AN ACT to repeal and re-enact with amendments Sections
380 and 391 of Article 23 of Bagby's Annotated Code of
the Public General Laws of Maryland, title "Corporations, "
sub-title "Public Service Commission. "

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 380 and 391 of Article 23 of Bagby's
Annotated Code of the Public General Laws of Maryland, en-
titled aCorporations, " sub-title "Public Service Commission, "
be and the same are hereby repealed and re-enacted with
amendments so as to read as follows:

Section 380. No common carrier, railroad corporation or
street railroad corporation shall abandon or discontinue in
whole or in part, the exercise of any franchise or right, under
any provision of the railroad law, or any other law, in so far
as it is then actually being exercised for the public service,
without the permission and approval of the Commission first
obtained, after due hearing, and the determination by the Com-
mission that the present or future public convenience or neces-
sity permit of such abandonment or discontinuance of the
exercise of such franchise or right.

Section 391. No gas corporation or electrical corporation
incorporated under the laws of this or any other State shall
abandon or discontinue in whole or in part, the exercise of any
right or privilege under any franchise granted to it in this
State in so far as such right or privilege is then actually being
exercised for the public service, without having first obtained
the permission and approval of the Commission, after due
hearing and the determination by the Commission, that the
present or future public convenience or necessity permit of
such abandonment or discontinuance of the exercise of such
franchise or right.

AN ACT to regulate the use of public roads and highways
within Howard County, other than highways under the con-
trol of the State Roads Commission.
