that if the Council should by a unanimous vote authorize the
issuing of said license, then the same shall be issued by the Clerk.
At the first regular meeting after each regular election for
Mayor and after the qualification of the newly elected mem-
bers, or as soon thereafter as may be convenient, the Mayor,
with the advice and consent of the Council, shall appoint one
person to be Clerk, Treasurer and Tax Collector; one person to
be Attorney and Counsel to the Mayor and Council; and one
person to be superintendent of the Water-Works; one person
to be Chief Bailiff; one person to be City Engineer; all of whom
shall hold office for two years and until the qualification of their
successors and three citizens of known integrity, experience and
sound judgment, one of whom shall be a physician, who, to-
gether with the Mayor and City Attorney, shall constitute the
Board of Health, and as such shall have all the authority within
the limits of said town that is now or may be hereafter vested
in the health officers of Frederick County or in inspectors of the
State Board of Health or that may be vested in them by the Char-
ter and Ordinances of said town. The members of said board
shall hold office for two years from the date of their respective
appointments, and until the qualification of their successors
and shall receive such compensation for their services as may
be allowed by ordinance, and the Mayor, with the advice and
consent of the Council, shall appoint such other officers and
committees as may be required for the conduct and regulation
of Municipal affairs. The Mayor shall have the sole power of
appointments of all officers herein provided for, subject to con-
firmation by a majority of all the members elected to the Coun-
cil, which confirmation shall not be later than the next regular
meeting after the receipt of such appointment or appointments.
If the Council fails to take action within the time, then the per-
son or persons nominated shall be to all intents and purposes
such officer or officers as if they had been confirmed by the city
council.

If the Council shall by the required vote and in the pre-
scribed time refuse to confirm such nomination or nominations,
the Mayor shall, at the next regular meeting of the Council send
to it another name or names for such office or offices, and the
duties of the city council and mayor shall continue to be as
above prescribed until a confirmation is had or a failure to act
as aforesaid by the city council.

All the vacancies occurring in the offices which the mayor has
the power to fill, subject to the ratification or confirmation of
the city council during the recess of the city council, shall be
filled by the Mayor until the next regular meeting of the Coun
cil, at which meeting the Mayor shall present the name of a person
for each office in which such vacancy has occurred for the con-
firmation by the Council, and the mode and manner of procedure
