CHAPTER 178.
AN ACT to add six new sections following Section 402 of Chap-
ter 680, laws of Maryland, 1916, title. ''Harford County.
Maryland, " sub-title, ''Havre de Grace, " providing for the
creation of a Municipal Utility Commission, and defining
the duties and qualifications of its members, its jurisdiction
and powers.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That six new sections be added to Section 402 of Chap-
ter 680. laws of Maryland, 1916, title. "Harford County, " sub-
title "Havre de Grace, " to be known as Sections 402-A, 402-B,
402-C. 402-D, 402-E and 402-F. so as to read as follows:
Section 402-A. In the event at any time the Mayor and
City Council of Havre de Grace shall acquire in any manner
whatsoever the property and assets of any person, firm or cor-
poration furnishing electricity, water or other public necessity
and service to the City of Havre de Grace, or its citizens, or
shall decide to inaugurate the furnishing of electricity, water
or other public necessity or service to the City of Havre de
Grace, or its citizens, such property and assets when acquired
shall be vested for its control, supervision and operation in
a commission known as the Municipal Utility Commission.
Section 402B. Said Municipal Utility Commission shall
consist of three persons who shall not be less than thirty years
of age and who arc citizens and taxpayers of the City of
Havre de Grace, and the said persons, hereinafter called com-
missioners, shall be appointed by the Mayor of Havre de Grace,
by and with the consent of City Council, and shall receive as
compensation for their services as said commissioners the sum
of $100. 00 each per annum. One of the first three of said com-
missioners appointed shall hold office for two years, one of the
first three for four years, and one of the first three for six years,
and as the terms of each of the first three shall expire, succes-
sors shall be appointed by the Mayor of Havre de Grace, by and
with the consent, of City Council, for a term of six years, and
thereafter at the expiration of the term of any commissioner his
successor shall be appointed for six years. In the event, how-
ever, of a vacancy occurring in the office of any commissioner
through death, resignation or otherwise, a commissioner shall
be appointed by the Mayor to fill out the remainder of the
term of said member who has died, resigned or otherwise ren-
dered his office vacant.
