and warning all abutting owners to appear at the time and place
stated in said advertisement or notices, to show cause, if any
there be, why said assessment should not be made as proposed.
Any person aggrieved by the action of the Mayor and City
Council of Friendsville shall have the right to appeal to the
Circuit Court for Garrett County, Maryland, provided such ap-
peal is taken within ten days next succeeding the day of which
said assessment is made. All assessments authorized under
this Act shall, be collected as other town taxes are collected.
SEC. 9. And be it further enacted, That the Mayor and City
City Council of Friendsville shall be required to consider the
improvement of said roads by hard-surfacing them, as provided
for herein, when ever fifty per centum of the property owners,
where property shall abut upon such roads, shall petition the
Mayor and City Council to that effect, but. the Mayor and City
Council of Friendsville shall have the discretion and final de-
termination as to the construction of all said work, not-
withstanding such petition.
SEC. 10 And be it further enacted, That at a special election
to be held in the town of Friendsville after the taking effect
of this Act and the exact date of which to be determined by the
Mayor and City Council, there shall be submitted to the quali-
fied voters of Friendsville the questions whether the Mayor and
City Council of said town shall have authority to improve the
roads of the said town by hard-surfacing them and to issue
bonds and to make an assessment to pay for the said improve-
ment, and at such special election the ballots used and cast up-
on the questions shall have printed or written thereon the words
"For the Improvement, Bond Issue and Assessment" and
"Against the Improvement, Bond Issue and Assessment" and
if a majority of the votes cast upon said questions shall be "For
the Improvement, Bond Issue and Assessment'', then the Mayor
and City Council shall proceed to exercise the power vested in
them by this Act; but if a majority of the votes cast upon said
questions shall be "Against the Improvement. Bond Issue and
Assessment", then the questions before mentioned shall be sub-
mitted in the same manner at the succeeding regular town elec-
tion for a period of three successive years if they shall not be
be approved before the expiration of such period. If at the
last regular election in such period, the majority of the votes
cast upon said questions shall be "Against the Improvement.
Bond Issue and Assessment", then this Act shall be null and
