1172 LAWS OF MARYLAND. [CH. 480

SEC. 7. And be it further enacted, That annually on or
before the first Monday in June, the Mayor and Council shall
appoint two judges, who shall appoint a clerk, to conduct an
election by ballot on the first Monday in July, if not a legal
holiday, and if a legal holiday, then on the day following, for
the election of officers as provided for in Section 5 of this Act.
The polls shall be open between the hours of five and nine
P. M.; the two judges and the clerk above provided for shall
constitute the Board of Election Supervisors for said town, and
shall determine the qualifications and right of each voter to
participate in the town election by asking each applicant who
presents himself to vote at the election which they have been
appointed to conduct, under oath, these questions: First, What
is your name? Second, Have you resided in Colmar Manor
for a period of one year immediately preceding this election?
Third, Are you 21 years of age or over? Fourth, In what ward
do you live? And should the answers of the applicant be in
the affirmative to the second and third questions, then it shall
be the duty of said Board of Election Supervisors to allow
such applicant to cast his ballot in the ward in which he resides,
and should the answer of the said applicant be in the negative
to either of the above second and third questions then and in
that event he shall not be allowed to vote. Should the applicant
answer any one of the above provided questions falsely he shall
be guilty of the crime of perjury and be subject to the penalties
provided by the laws of the State of Maryland. The judges
shall provide themselves with a list of the voters living within
the boundaries of said town, and if a person votes whose name
is not on said list a record shall be made of that fact, and the
truth of such person's answers to the above provided questions
shall be investigated, and, if found to be false, it shall be the
duty of said judges to cause the offender to be indicted for
perjury. They shall also prepare ballots containing the names
of those persons who have complied with the provisions herein
specified making them eligible to become a candidate for the
office for which they seek. The Mayor and Council shall re-
ceive all returns of elections and determine all questions
arising thereunder.

SEC. 8. And be it further enacted, That any person desiring
to ran for said Mayor, Treasurer, or Councilman of said town,
shall be at least twenty-five years of age and shall have resided
within the boundary limits of said town for at least one year
immediately prior to election and each of whom shall have an
equity in real property in said town of Colmar Manor, the
