to the Councilmen or Councilman elected the fact of there being
a tie and the said Councilmen or Councilman shall at the first
Board meeting thereafter designate one of the said persons who
received a tie vote to be Mayor or Councilman as the case may
be; and the Mayor or Councilman, as the case may be, shall
hold his office as fully as if he had received the highest number
of votes.

SEC. 2. Be it further enacted as aforesaid, That this Act is
hereby declared to be an Emergency Law and necessary for the
immediate preservation of the public safety, and being passed
upon a yea and nay vote supported by three-fifths of the mem-
bers elected to each of the two Houses of the General Assembly,
the same shall take effect from the date of its passage.

CHAPTER 406.

AN ACT to amend the Charter of Ellicott City (1) by repeal-
ing and re-enacting with amendments, Section 51, of Article
14, of the Code of Public Local Laws of Maryland, title
"Howard County", sub-title "Ellicott City", as said Sec-
tion was enacted by Chapter 528 of the Acts of 1922, (2)
by repealing and re-enacting with amendments, Sections
67, 70, 71, and 81B of said Article, as said Sections were
enacted by Chapter 836 of the Acts of 1914, and (3) by
repealing and re-enacting with amendments, Section 77, of
said Article, as said Section was enacted by Chapter 207
of the Acts of 1918.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 51, of Article 14 of the Code of Public Lo-
cal Laws of Maryland, title "Howard County", sub-title "El-
licott City", as enacted by Chapter 528 of the Acts of 1922,
be, and the same is hereby, repealed and re-enacted with
amendments, so as to read as follows:

51. The affairs of said corporation shall be managed by three
(3) Commissioners, who shall be the owners of real estate situ-
ated in said City, and resident voters thereof; and an
election for the said three (3) Commissioners of Ellicott City
shall be held on the first Tuesday after the first Monday of
August, 1914, between the hours of eight o'clock A. M. and
seven o'clock P. M., at such place in said City as may be desig-
nated by the present Mayor of said City. Notice of said elec-
