facia correct in any suit or settlement between said city and
any of the officers herein mentioned. The said certified public
accountant shall be paid out of the city treasury for his serv-
ices herein prescribed a sum not to exceed the sum of six hun-
dred ($600) dollars. The Mayor shall have full power to regu-
late the duties of said certified public accountant; and before
he shall be entitled to payment for said services, said account
of said certified public accountant shall be presented to the
City Council, and if found to be correct shall be ordered paid
out of the money in the city treasury.

94. It shall not be lawful for any officer or employee of the
Mayor and City Council, or the Mayor, or any member of the
City Council in his individual capacity, or as a member of any
committee, or for any committee of the City Council, to make
any purchase, incur any obligations, or in any way pledge the
faith and credit of the city for any sum for any purpose what-
ever, without first having obtained the written order of the
Council, approved by the Mayor (or passed over his veto, as
the case may be) and any debt or obligation contracted in vio-
lation of the provisions of this section shall be altogether and
every way subject to the approval and ratification of said
Mayor and City Council.

95. During the month of April in each and every year the
said Mayor and City Council of Cumberland shall make ap-
propriations for each and every department of the city govern-
ment and shall also provide an appropriation of not more than
$10, 000. 00 to be known as the Contingent Fund, and said ap-
propriations when so made shall not be changed, nor shall any
of said appropriations be overdrawn by any department before
January 1st of the succeeding year.

96. It shall be the duty of the City Auditor to advise the
said Mayor and City Council when any appropriation is about
to be overdrawn or is overdrawn prior to January 1st of each
year, and at the first meeting of said Mayor and City Council
held after January 1st of each year it shall be the duty of the
said City Auditor to file with the said Mayor and City Coun-
cil a report showing the amounts of said appropriations still
unexpended in each department, and upon receipt of said re-
port the said Mayor and City Council may from time to time
by majority vote, appropriate money from the Contingent
Fund to such departments as they deem in need of additional
appropriations, and they may also from time to time, after the
