yond the limits of the City of Cumberland to dump, empty, or
place any ashes, refuse or debris of any sort in the stream of
water commonly known as Wills Creek.
51. Any person violating the provisions of the preceding
section shall be deemed guilty of a misdemeanor, and upon con-
viction thereof shall be fined not less than five ($5. 00) dollars
nor more than twenty-five ($25. 00) dollars for each offense.
52. Said Mayor and City Council shall have power to en-
force their ordinances by fines and penalties and by imprison-
ment, and may establish and maintain a city prison, and may
confine therein all persons convicted of violations of their ordi-
nances in default of the payment of fines imposed for such vio-
lations, or may at their option confine such persons in the coun-
ty jail at the expense of said city, or they may require such
persons in default in the payment of fines to work out such fines
and costs upon the streets or other improvements, of said city;
such persons to be allowed as a credit on such fines and costs
the same wages as are paid other employes of said city for the
same work.
53. All fines, penalties and forfeitures imposed by any sec-
tion of this Act or for the violation of any ordinance of said
city, shall be recoverable in the name of the Mayor and City
Council of Cumberland before such Justice of the Peace of the
State of Maryland residing in said city as may be elected as
Police Magistrate for said city, by said Mayor and City Coun-
cil, and no other, as debts, and shall be paid to the Mayor and
City Council, for the use of said city.
54. Any one shall have the right to appeal to the Circuit
Court for Allegany County, from any decision or judgment of
the Police Magistrate of the City of Cumberland, in any case
or trial for the violation of any of the laws or ordinances of the
said City of Cumberland.
55. Said Mayor and City Council shall have power to levy
and collect a tax on the assessable property of said city for the
general purposes of said corporation, not exceeding in any one
year seventy-five cents on each one hundred dollars worth of
said assessable property; to levy and collect such a tax on the
assessable property of said city as may be necessary to pay the
interest on the city bonds and to provide a sinking fund for the
redemption thereof at maturity; provided, however, that the
bonded indebtedness of said city shall not exceed at any one
