provided, however, that if the said charges shall not be sus-
tained by said Court, then the said Mayor or Councilman
charged as aforesaid shall be entitled to full pay from the time
of the order of dismissal passed by the said Mayor and City
Council. The Commissioner named as the head of each depart-
ment shall audit all accounts or claims against it, unless he be
absent or fail or refuse to do so, in which event the Mayor
shall appoint another Councilman to act in his stead during
his absence, or to audit such claims and accounts as the said
Commissioner shall fail or refuse to act upon, but before pay-
ment all accounts shall be acted upon and approved by a ma-
jority of those present at a meeting of said Mayor and City
Council.

Said Council shall require a statement to be published in
January, April, July and October of each year in two news-
papers of said city, showing a full, clear and complete state-
ment of all taxes and other revenues collected and expended
during the preceding quarter, indicating the respective sources
from which the moneys are derived, and also indicating the dis-
position thereof, and it shall be the duty of the Commissioner
of every department to make a report in writing at the first
meeting of the Mayor and City Council each and every month
of the conditions in his department during the preceding
month.

21. Whenever the Mayor shall deem it necessary, in order
to enforce the laws of the city, or to avert danger or protect
life or property, in the case of a riot or any outbreak or calam-
ity or public disturbance, or when he has any reason to fear
any serious violation of the law or order or outbreak, or any
other danger to said city or the inhabitants thereof, he shall
summon into service, as a special police force, all or as many
of the citizens as in his judgment and discretion may be neces-
sary and proper; and said summons may be by proclamation or
order, addressed to the citizens generally, or those of any ward
of the city or sub-division thereof, or such summons may be
by personal notification; such special police, while in service,
shall be subject to the orders of the Mayor, shall perform such
duties as he may require, and shall have the same powers while
on duty as the regular police force of said city; and any person
so summoned, and failing to obey or appearing and failing to
perform any duty that may be required by this Act, shall be
fined in any sum not exceeding one hundred dollars ($100).
