Capitol Heights when and as collected three-fourths of all the
taxes for public roads on property within the limits of the
said town, which shall be expended by the Mayor and Com-
mon Council exclusively in the repair and improvements of
streets and roads within the limits of said town.

43. The Mayor and Common Council shall not expend or
contract to expend in any one fiscal year more money than
the amount receivable from taxes and other sources during that
year, except from special assessments as herein provided. The
Mayor and Common Council may also from time to time bor-
row money for the use of the town and issue therefor the bonds,
notes or other obligations of the town, to an amount not exceed-
ing as the principal the sum of fifteen thousand dollars of out-
standing indebtedness at any one time, the same to bear such
rate of interest and to be payable or renewable in such manner
as said Mayor and Common Council may agree; provided
further, however, that no such moneys shall be so borrowed on
either notes, bonds or other obligations, unless the issue of
said bonds, notes or obligations shall first have been submitted
to the vote of the voters of the town, and shall have received
the favorable vote of a. majority of the votes cast, and such
question may be so submitted to the voters either at any regu-
lar election or any special election called for that purpose by
the Mayor and Common Council in accordance with the provi-
sions herein provided for the holding of other elections. Pro-
vided further, that the Mayor and Common Council shall be
authorized and required to create and maintain a sinking fund
for the repayment of any loans so made to the town.

44. All streets, avenues, roads, bridges, and public alleys in
the corporate limits of said town of Capitol Heights are hereby
declared to be under the supervision and control of said Mayor
and Common Council, provided, that this section shall not ap-
ply to State Roads or County Roads.

45. For neglect of duty or incompetency any town agent or
official appointed by the Mayor or by the Mayor and Common
Council may be removed from office at any time by a majority
vote of the Common Council and the Mayor, the Mayor's vote
to be equal to that of any one of the members of the Common
Council for this purpose.

46. In all cases where any municipal work of whatsoever
character is to be done within the corporate limits of Capitol
Heights, the estimated cost of which shall exceed the sum of
