so summoned, shall respectively appear before the said commissioners, and take the following oath,
wit: " I, A. B. do swear, that I will honestly, without favour, prejudice or partiality, value the
damages and injury sustained by opening a road through the lands of C. D. in pursuance of this
" act," and shall return an inquisition of such damages to the clerk of the county court of Queen-
Anne's county, and the damages so assessed shall be conclusive.

C H A P.
XXIX.

IV. AND BE IT ENACTED, That the persons who may conceive themselves interested or benefit-
ted by such road or roads, are hereby required to pay, or secure to be paid, into the hands of the
commissioners aforesaid, or some one of them, for the use of the person or persons in whose favour
such valuation shall be made, previous to laying out and opening the roads aforesaid, whatever da-
mages be as aforesaid adjudged to the party sustaining such damages, and in case of failure of such
security or payment as aforesaid, this act to be null and void, but in case of compliance with the
provisions of this act, the said roads are to be considered as public roads, and to be kept up in the
same manner as other public roads in said county.

V. AND BE IT ENACTED, That if any of the commissioners named in this act shall die, resign,
or refuse to act, the remaining commissioners, or a majority of them, shall and they are hereby au-
thorised to supply such vacancy, by the appointment of another person.

CHAP. XXX.

How vacancies
are to be filled.

A Supplement to an act, entitled, An act for the valuation of real
and personal property within this state.

ry 5, 1805.

BE IT ENACTED, by the General Assembly of Maryland, That the commissioners of the tax for the
several counties in this state, on the first day of their meeting in each year for the purpose of
altering and correcting the account of any person who may have lost, transferred or alienated any
property, shall proceed to appoint a clerk, who, before he enters upon the duties of his office, shall
take the following oath, or affirmation, (as the case may be,) to wit; " I, A. B. do swear, or affirm,
" that as clerk to the commissioners for —— county, I will, to the best of my skill and judgment,
" execute the duties of said office without favour, affection, partiality or prejudice;" which oath, or
affirmation, any one of the commissioners of the tax, or any justice of the peace, may administer.

II. AND BE IT ENACTED, That the. said commissioners shall direct their clerk to deliver to the
clerk of his county, together with the summary account or list, a duplicate of the alphabetical list
of the owners or persons chargeable with the assessment of property within their county, with the
amount of each person's assessed property annexed to his or her name, and in case such clerk shall
neglect or refuse to comply therewith, he shall forfeit and pay the sum of fifty dollars for every such
offence.
CHAP. XXXI.

An ACT for the relief of John Cushwa, junior, of Washington
county.

ry 12, 1805.

WHEREAS it is represented to this general assembly, by the petition of John Cushwa, of
Washington county, a citizen of the United States, that he hath lately purchased part of a
tract of land lying in said county, called Poverty Increased, of a certain Stephen Freeman : And
whereas some doubts have arisen as to the validity of the title of the said John Cushwa, junior, to
the said property, in as much as the said Stephen Freeman was never naturalized agreeably to the
laws of the United States; therefore,

Preamble,

II. BE IT ENACTED, by the General Assembly of Maryland, That the title of the said John Cushwa,
junior, to the aforesaid part of the said tract of land caiied Poverty Increased, shall be and the same
is hereby made, as perfect and complete, to all intents and purposes, as if the said Stephen Freeman
had been naturalized agreeably to the laws of the United States before the said purchase was made,
any law of this state to the contrary notwithstanding; provided always, that nothing in this act con-
tained shall in any manner defeat or affect any right, title or claim, to the said property, or any part
thereof, acquired or prosecuted by any person or persons whatever before the passage of this act.

WHEREAS it is represented to this general assembly, by the petition of James Sim, of Caecil
county, that there is due to him from said county a balance of upwards of two hundred pounds
