VIII. AND BE IT ENACTED, That this act shall continue and be in force for and during the con-
tinuance of the original act to which it is a supplement,

An ACT authorising Lawrence Brengle, collector of Frederick coun-
ty, to complete his collection.

WHEREAS it is represented to this general assembly, by the petition of Lawrence Brengle,
collector of Frederick county, that from various causes therein set forth he has not been able
to complete his collection within the time limitted, and thai there is still due him, as collector of
said county, considerable sums of money, and praying that a law may pass to enable him to colled
the same; therefore,

Preamble.

II. BE IT ENACTED, by the General Assembly of Maryland, That the said Lawrence Brengle be and
he is hereby authorised and empowered to collect, until the first day of November, eighteen hundred
and five, all balances due him as collector of Frederick county for the year eighteen hundred and
four, in the same manner as he could or might have done within the time limitted by law, any law
to the contrary notwithstanding.

III. AND BE IT ENACTED, That it shall be the duty of the said Lawrence Brengle, before he
proceeds to execute or distrain the property of any person or persons for taxes or public dues in vir-
tue of this act, to deliver to such person or persons chargeable with the same, at least thirty days
previous to levying such execution or distress, an account, written in words at full length, of the
taxes or public dues demanded of him, her or them, with an affidavit annexed, if required, that he
hath not received any part thereof, nor any thing as security or satisfaction for the same, more than
credit given, to the best of his knowledge.

IV. AND BE IT ENACTED, That the said Lawrence Brengle, before he derives any benefit from
or under this act, shall lodge a copy of his collection books in the clerk's office of Frederick county,

to be open for the inspection of all persons interested in the same.
CHAP. XXVIII.

Books to be
lodged, &c.

An ACT to lay out and open a road through Tuckahoe Neck, in
Caroline county.

ry 5, 1805.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants of
Caroline county, that they suffer many inconveniencies from the want of a road to commence
at or near John Ruth's mill, in Tuckahoe Neck, and to run in the streightest direction that the na-
ture of the ground and other circumstances will admit, until it intersects the public road leading from
Denton to Price's ferry, at or near a causeway at the northerly corner of the late Henry Rhodes's
plantation, in Caroline county; therefore,

Preamble.

II. BE IT ENACTED, by the General Jssemlly of Maryland, That George Martin, Thomas B. Baffin,
John Ruth, James Hicks and William Oxenham, or any three of them, be and they are hereby ap-
pointed commissioners to survey, lay out, open and clear, at the expence of the petitioners, or any
part of them particularly interested therein, a roact, not exceeding thirty feet in width, to commence
at or near John Ruth's mill, in Tuckahoe Neck, and to run in the best and streightest direction that
the nature of the ground and other circumstances will admit, until it intersects the public road lead-
ing from Denton to Price's ferry, at or near a causeway at the northerly corner of the late Henry
Rhodes's plantation, in Caroline county; and the road, when so opened at the expence of the peti-
tioners as aforesaid, and the valuation herein after directed to be made shall be paid, or secured to be
paid, to the individuals concerned, shall be recorded among the records of Caroline county court,
and be thereafter deemed and taken to be a public road for ever, and shall be kept in repair in the
same manner as other public roads in said county.

III. AND BE IT ENACTED, That the said commissioners may appoint one of their number as trea-
surer, and give him a certificate under their hands of his appointment, who is hereby enjoined and
empowered to collect and receive all monies subscribed, or that may be subscribed, for the purpose
of opening the said road, and such subscribers are hereby directed to pay their several subscriptions
to the treasurer appointed as aforesaid; and if any person shall neglect or refuse, when applied to by
the aforesaid treasurer, to pay his subscription money, the said treasurer may and he is hereby au-
thorised to sue for, recover and receive the same; and the said monies, when received, shall be ap-
plied by the commissioners, or any three of them, to the purpose of this act.
