CHAP. LVII.

1803,

An ACT authorising a lottery to raise a sum of money for building
bridges over the Conococheague creek in Washington county.

Fussed 7th of
January, 1804,

BE IT ENACTED, by the General Assembly of Maryland, That it-shall and may be lawful for Natha-
niel Rochester, Eiie Williams, Samuel Ringgold, Jacob Schnebly, William Hyser, Martin
Kershner and Jacob T. Towson, or a majority of them, to propose a scheme or schemes of a lottery
for raising a sum oi7 money, not exceeding five thousand dollars, exctusive of the expence of the said
lottery, and to sell and dispose of the tickets thereof; provided the said Nathaniel Rochester, Elie
Williams, Samuel Ringgold, William Hyser, Martin Kershner and Jacob T. Towson, or such ma-
jority of them as shall undertake to act under this law, shall, before the sale or disposal of any
ticket or tickets in said lottery, give their bond to the state of Maryland, In the penalty of ten
thousand dollars, conditioned that they will well and truly apply so much of the money arising
therefrom, within six months after the drawing of said lottery, as will satisfy the fortunate adven-
turers for prizes drawn by them, and after deducing the necessary expences Incurred in said lottery,
shall, within two years from the time of drawing said lottery, apply the balance arising from
said lottery, in equal proportions, in building two bridges over the Conococheague creek, to wit:
One at William's Port, and one at Hitter's ford.

II. AND BE IT ENACTED, That if a majority of the said commissioners should be of opinion that
a safe and permanent bridge cannot be erected where the road crosses the said creek at either of the
places above mentioned, they shall have full power and authority to fix the scit.es for building either
of the said bridges, either up or down the said creek, within two hundred perches from where the
roads now cross the same at the places above mentioned, and they shall, immediately after the com-
pletion of either of the said bridges, lay out a road from each end of the bridge, so completed, to
intersect the old road, as the case may be, in as streight a direction as the nature of the grounds,
and the restrictions herein after mentioned, admit of, not exceeding sixty feet in width, and make
return of plain plots and explanations of the same to the levy court of Washington county, who are
hereby authorised to reject or confirm the same, and when confirmed, shall cause the same to be re-
corded among the land records of Washington county; which said road or roads shall be opened
and improved, and shall be kept in repair, as all other public roads in said county are by law di-
rected; provided that the said road or roads, so altered, shall not be made to run through any build-
ing, enctosed yard, garden or orchard, without the consent of the owner.

III. AND BE IT ENACTED, That a majority of the said commissioners shall have, full power and
authority to agree and contract with the person or persons over whose lands the said roads so altered
shall pass for the amount of damages thereby sustained, and make return of such contract or con-
tracts to the levy court, of Washington county, which, when confirmed by them, shall be levied and
paid as in like cases in said county.

IV. AND BE IT ENACTED, That the said commissioners shall keep fair and plain accounts of all
monies raised and expended, in virtue of this act, and return the same to the said court within two
years after the drawing of the said lottery; and in case any of the said commissioners should die,
resign, or refuse to act on notice, the said, court shall appoint another person, who shall be vested
with all the powers, and subject: to all the penalties, of the original commissioners, who, when so
appointed, and before he proceeds to act, shall give bond as before directed by this act.

V. AND BE IT ENACTED, That it shall be the duty of said commissioners, before they act as
such, to lodge such bond, in the cterk's office of Washington county, there to be recorded, and upon
such bond, or any office copy thereof, suit or suits may be instituted against the obligors therein, or
any of them, or their legal representatives, for any breach or non-compliance, with the condition of
the same,

ney for the purpose of finishing the Roman catholic church in Fre-
derick-town, in Frederick county.

WHEREAS it is represented to this general assembly, that some of the commissioners appoint-
ed under the original act to which this is a supplement will not undertake to act; therefore,
