arc very much out of repair, and that by reason of debts heretofore contracted by the vestry in
making repairs thereon their funds are inadequate to carry into effect their intentions of completing
the repairs on the said church and burial-ground, and have prayed that a law may pass authorising
a lottery to. raise a sum of money for the above purposes; therefore,

CHAP.
XLIII.

II. BE IT ENACTED, by the General Assembly of Maryland, That it shall and may be lawful for Oli-
ver Smith, doctor William Briscoe, George Yeates, Jacob Freeman, James Blackistone, James Sa-
lisbury and Edward Wright, or a majority of them, to propose a scheme of a lottery for raising a
sum of money, not exceeding four thousand dollars, and to sell and dispose of the tickets thereof;
provided the said Oliver Smith, doctor William Briscoe, George Yeates, Jacob Freeman, James
Blackistone, James Salisbury and Edward Wright, or such majority of them as shall undertake to
act under this law, shall, before the sale or disposal of any tickets in said lottery, give their bond
to the state of Maryland, in the penalty of ten thousand dollars, conditioned that they will faith-
fully apply so much of the money arising therefrom, within six months from the time the drawing
the said lottery shall commence, as will satisfy the fortunate adventurers for prizes drawn by them,
and after deducing the necessary expences incurred in conducing said lottery, shall pay over the
residue of the money so raised to the vestry of Shrewsbury parish in Kent county, who are hereby
authorised to receive the same, and to appropriate it in repairing the said church and the enctosure
of the burial-ground, and in the payment of debts heretofore contracted for repairs on the said
church, in such manner as they may think proper.

III. AND BE IT ENACTED, That it shall be the duty of said commissioners, before they act as
such, to lodge such bond in the cterk's office of Kent county, there to be recorded, and upon an office
copy of such boad, suit or suits may be instituted against the obligors therein, or any of them, or
their or any of their legal representatives, for any breach or non-compliance with the condition
thereof.

CHAP. XLIV.

Bond to be
lodged, &c.

An ACT to establish a market, and to build a market-house, in
the western precinds of Baltimore, and for the regulation of the
same.

Passed 7th of
January, 1804.

WHEREAS the creating a market-house in the western precincts of the city of Baltimore,
will be attended with great convenience to the inhabitants thereof, and to the inhabitants
of Baltimore and other counties, and the same has been prayed for by the petition of a large
number of subscribers living in the city and precincts of Baltimore, and in Baltimore county; there-
fore,

Preamble.

II. BE IT ENACTED, by the General Assembly of Maryland, That John E. Howard, John S. Home,
Daniel Lamot, Christopher Johnson, Adam Welch, George Warner and George F. Warfield, or a
major part of them, be and they are hereby appointed commissioners for the time being of the mar-
ket-house hereby to be erected, and as such, shall have full power and authority hereby vested in
them to fix upon a lot or lots of ground in the western precincts of Baltimore, in such a "situation as
In the judgments of a majority of them shall be considered most eligible and convenient for a mar-
ket-house, and the same to contract for and purchase, and to receive a deed or deeds therefor, exe-
cuted in due form oF law, to them and their successors; and the right and title to the said lot or
lots of ground, when conveyed as aforesaid, shall be, and the same is hereby dectared to be, vested
in the said commissioners, and their successors, for ever, to hold, possess and enjoy the same, and
the market-house thereon, to and for the use and benefit of Baltimore, and the precincts thereof, in
as full and ample a manner as if the said commissioners had been legally constituted a body politic
and corporate, in deed and in name; and the said commissioners are hereby authorised and empow-
ered to erect and build a market-house upon the said lot or lots, so to be conveyed as aforesaid, and
for that purpose to contract for and purchase materials, and to contract and agree for the building of
the same; provided always, that the said commissioners, or a major part of them, shall, on or before
the first Monday of February next, enter into bond to the state of Maryland, in the penalty of
thirty thousand dollars, with condition that they the said commissioners, or a major part of them,
shall erect and build, or cause to be erected and built, a market-house, in a good, substantial, work-
manlike manner, according to such plan as the levy court of Baltimore county shall approve, and
shall finish and complete the same on or before toe first Monday of February, eighteen hundred and
six, which bond .shall be lodged with the cterk of Baltimore county, court for safe keeping, and upon
