VI. AND BE IT FURTHER ENACTED, That the levy court of the said county, at the time of lay-
ing the next levy for the said county, or at any time within six months after the said road shall be
opened and cteared as aforesaid, shall levy, on the assessable property of the said county, such sum
Or sums of money as they may deem necessary for the purpose of surveying, opening, ctearing and
repairing, the said road; and at their said levy court -next after the return of said plot, they are
hereby farther authorised and empowered to levy the damages sustained by the owners of the land
through which the said road shall pass, and also for the compensation to the commissioners as is
herein before directed to be paid.

An ACT authorising certain lotteries within the city of Baltimore.

WHEREAS it is represented to this general assembly, by the trustees of the Impartial Free-
school , and by the committee of the second presbyterian church, in the city of Baltimore,
that their funds are inadequate to carry into effect the laudable purposes contemplated by the petiti-
oners, and praying that a law may pass authorising them to raise by lottery certain sums of money:
And whereas by an act, entitled, An act to erect Baltimore-town, in Baltimore county, into a city,
and to incorporate the inhabitants thereof, the drawing of lotteries within the said city is confined
to special purposes; therefore,

Preamble,

II. BE IT ENACTED, by the General Assembly of Maryland, That from and after the passage of this
act, it shall arid may be lawful for the mayor and city council of Baltimore to authorise the trustees
of the Impartial Free-school, and the committee of the second presbyterian church, in the city of
Baltimore, respectively, to institute a scheme or schemes of a lottery or lotteries within the said
city, and to dispose of tickets therein, for the purpose contemplated by this act, under such limita-
tions as the mayor and city council shall by ordinance direct.

An ACT authorising a lottery to raise a sum of money to purchase
a fire-engine and to ered pumps in the town of Easton, in Talbot
county.

Dec. 1803.

WHEREAS it has been prayed to this general assembly, that an act may pass authorising a lot-
tery for raising a sum of money for the purpose of purchasing a fire-engine and for erecting
pumps in the town of Easton, in Talbot county; therefore,

Preamble.

II. BE TT ENACTED, by the General Assembly of Maryland, That Bennett Wheeler, Nicholas Ham-
mond, Peter Denny, James Earle, junior, and Thomas Perrin Smith, or a majority of them, be and
they are hereby authorised to propose a scheme of a lottery for raising a sum, not exceeding two
thousand dollars, for the purpose aforesaid, and to sell and dispose of the tickets therein.

Managers to
give bond, &c.

III. AND BE IT ENACTED, That the said Bennett Wheeler, Nicholas Hammond, Peter Denny,
James Earle, junior, and Thomas Perrin Smith, before they proceed to the sale of any ticket or
tickets in said lottery, shall give a bond to the state of Maryland, in the penalty of four thousand
dollars, conditioned that they will well and truly apply the monies arising therefrom, within ninety
days after the drawing thereof, to the payment of the prizes drawn therein to the adventurers to
whom they shall be due, and the necessary expences incurred, in the management thereof, and the
residue in twelve months to the purchase of a fire-engine and erecting pumps for the use of the
said town.

A scheme may

IV. AND BE IT ENACTED, That the said bond shall be lodged in the cterk's office of Talbot
county, to be there recorded, and upon such bond, or any office copy thereof, suit or suits may be
instituted for any breach or non-compliance with the condition thereof.
