CHAP. XCVIII.

An ACT requiring the register of wills of Baltimore county to give
daily attendance at his office.

BE IT ENACTED, by the General Assembly of Maryland, That from and after the passage of this act
it shall, and it is hereby declared to be, the duty of the register of wills of Baltimore county
to give daily attendance at his office in the city of Baltimore, either in person 'or by deputy, for the
purpose of discharging the duties incident thereto.

Preamble.

An ACT to lay out a road in Anne-Arundel and Baltimore counties.

WHEREAS it Is represented to this general assembly, by the petition of Francis Holland,
James Crosall, and sundry inhabitants of Anne-Arundel and Baltimore counties, that the
convenience of the public would be greatly promoted by opening a road from Francis Holland's land-
ing, on Patapsco river, until it shall intersect the road leading to the city of Annapolis, and also to
straighten and amend the road leading from James Groxall's point, in Baltimore county, until it shall
intersed the George-town road near Mrs. Carroll's bridge; therefore,

Commissioners
appointed, &c.

II. BE IT ENACTED, by the General Assembly of Maryland, That Oliver Cromwell, Horatio Johnson
and Ebenezer Steuart, be and they are hereby appointed commissioners to survey, lay out and open,
a road, not exceeding thirty feet wide, in the streightest and best direction that the nature of the
ground will admit, from Francis Holland's landing, on Patapsco river, until it intersecls the road
leading from Hammond's ferry to the city of Annapolis between Harrison's quarter and the Saw-
mill ran; and the said road, when so surveyed, laid: out and opened, and the valuation herein after
directed to be made shall have taken place, shall be recorded by the clerk of Anne-Arundel county,
and shall for ever thereafter be deemed and taken to be a public highway, and kept in repair as other
public roads in said county.

mages, &c.

III. AND BE IT ENACTED, That the said commissioners, or a majority of them, shall ascertain
and value what damages may be sustained by any person or persons through whose lands the said
road shall pass, taking, into consideration the advantages and disadvantages, if any, and the same,
when so assessed, shall be paid, or secured to be paid, by the said Francis Holland to the person or
persons entitled to receive the game, before the said road, after it is laid off, shall be opened and,
cleared.

IV. AND BE IT ENACTED, That Zachariah Mackubin, George Ellicott and Ezekiel John Dorsey,
be and they are hereby appointed commissioners to streighten and amend the road now open and
used, from James Croxall's point, on the river Patapsco, until it intersects the George town road at
or near Mrs. Carroll's bridge, on Gwinn's falls, in Baltimore county, of a width not exceeding thir-
ty feet, and the said road, when so straightened and amended, and the valuation herein after dice di-
ed to be made shall have taken place, shall be recorded by the clerk of Baltimore county, and shall
for ever thereafter be deemed and taken to be a public highway, and kept in repair as other public
roads in said county

V. AND BE IT ENACTED, That the commissioners last named, or a majority of them, shall, as-
certain and value what damages may be sustained by. any person or persons through whose lands the
road last described shall pass, taking into consideration the advantages and disadvantages, if any,
and the same, when so assessed, shall be paid, or secured to be paid, by the said James Croxall, to
the person or persons entitled to receive the same, within six. months after the said damages shall be
ascertained in the mode prescribed by this act

VI. AND BE IT ENACTED, That if any person or persons through whose lands the said roads shall
pass, or his, her or their guardian or trustee, shall conceive himself, herself or themselves, aggrieved
by such valuation and assessment of damages by the said commissioners respectively, it shall and
may be lawful for any justice of the peace, on his, her or their application, to Issue his warrant,
under his hand and seal, directed to the sheriff of the county, commanding him to summon twelve
disinterested men, qualified by law to serve as jurors in the county court, to meet upon the premises
on a certain day, of which ten days notice at least shall be given to the- party or parties interested;
and the said jurors, when so met, and having each first taken an oath, before some justice of the
peace, that he will, without favour, affection, prejudice or partiality, assess the damages sustained
