CHAP. XLL

1802.

A Supplement to the act, entitled, An act: to lay out a road from
Aquila Tarman's tavern to Thomas Cockey's mill, and from the
said mill to the road called The Deer Park Road

Passed 8th of
January, 1803.

WHEREAS Samuel Wheeler, of Baltimore county, by his petition to this general assembly hath
set forth, that the damages assessed by the commissioners named in the acr to which this is
a supplement, are not sufficient to indemnify him for the injury sustained by the location of the road
mentioned in the said original act through his land, and praying that a jury may be summoned to as-
certain the said damages upon oath; and the prayer of the said petition being reasonable, therefore,

Preamble.

II. BE IT ENACTED, by the General Assembly of Maryland, That any justice of the peace in and for
Baltimore county be and he is hereby authorised and empowered to issue his warrant, directed to the
sheriff of said county, commanding him to summons a jury of twelve good and lawful freeholders,
disinterested and unconnected, to be and appear before him, the said justice of the peace, on the
premises, on a certain day in the said warrant expressed, which jury, upon their oath, to be admi-
nistered by the said attending justice, shall inquire and determine what damages the said Samuel
Wheeler hath sustained by reason of the said road running through and over his said land, taking
into consideration the convenience and benefits, if any, and the disadvantages incurred, by the said
Samuel Wheeler by occasion of the said location of said road, and the said damages, when so as-
sessed as aforesaid by the inquest of the jury, under their hands and seals, shall be paid in the same
manner, and by the same person, as is directed in the said original act, any law to the contrary not-
withstanding.

An ACT for the relief of Patrick M'Gill, of Frederick county.

WHEREAS it is represented to this general assembly, by the petition of Patrick M'Gill of
Frederick county, that sometime in the year eighteen hundred an attachment was issued out
of the county court of Frederick by a certain Peter Coblentz, senior, against Jacob Goblentz, and
laid on a lot or parcel of ground in the county aforesaid, distinguished by lot number fourteen, in
New Freedom, but my mistake was returned by the. sheriff as lot number fourteen in New town, and
condemnation obtained thereon at the following term, on which judgment of condemnation fieri facias-
issued, and the said lot was sold by the sheriff, and purchased by said Patrick M'Gill, to whom the
said lot was by said sheriff conveyed as lot number fourteen in New-town : And whereas the title of
the said Patrick M'Gill by reason of the error aforesaid, is rendered doubtful and incomplete in
said lot; for remedy whereof,

Preamble.

II. BE IT ENACTED, by the General Assembly of Maryland, That the sheriff of Frederick county
execute a new deed to the said Patrick M'Gill, to be duly acknowledged and recorded within the

time limitted by law for the recording of deeds, for the lot and premises that was actually sold under
the attachment referred to in this bill for such an estate or interest as was by him or his deputy sold
to the said M'Gill, and that such deed shall have the same effect and operation as if no mistake had
been made on the return of said attachment; provided, that nothing herein contained, or the said
deed, shall extend or be construed to affect the right which, any other person may have acquired to
the said lot and premises.

An ACT to lay out and make a public road from the Black house in
Harford county to intersed the Pennsylvania line.

January, 1803

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants of
Harford county, that they labour under great inconvenience for want of a public road from a
place known by the name of the Black House, and leading past Henry Myer's mill, to intersect the
Pennsylvania line and a road leading by a certain doctor Boyd's, and praying that a road may be laid
off accordingly; and the same being reasonable, therefore,

Preamble.

II. BE IT ENACTED, by the General Assembly of Maryland, That Josiah Carter, James Varney and
Thomas Hope, be and they are hereby appointed commissioners, and they, or a majority of them, are
hereby authorised and empowered to view, layout, survey, mark and bound, a road, beginning at
the place known by the name of the Black House, and running thence agreeably to the old road as
now used, except where the same, In the judgment of the said commissioners, may require to be
