CHAP. XXXIX.

A Supplement to an act, entitled, An act to prohibit the
swine and geese in Princess-Anne-town, in Somerset county

BE IT ENACTED, by the General Assembly of Maryland, That from and after the first day of
eighteen hundred and three, it shall not be lawful for any person or persons to keen or rail!
any swine within the limits of Princess-Anne-town, in Somerset county, (except in styes or other
enclosures,) and if any swine, after the said first day of April, shall be found going at large within
the limits of said town, it shall be the duty of the town patroller, upon the information of any of
the inhabitants thereof, or upon his own view, to seize, secure, and detain in his custody, all such
swine so found going at large, until the owner or owners of such swine, so taken up, shall pay to
him the sum of two dollars, if an inhabitant, and the sum of one dollar, if not an inhabitant, of

said town, which money, so paid, shall be accounted for by the said patroller, and paid to the over-
seer of the screets of said town, except the sum of one shilling and six-pence for each and every
hog so taken up, to be retained by the said patroller for his trouble for each and every such swine
so seized; and in case such owner or owners shall refuse to pay the said sum of two dollars, if an
inhabitant, or the sum of one dollar, if not an inhabitant, of said town, then the said patroller
shall dispose of such swine at public sale to the highest bidder, and the money arising from the sale
thereof shall be accounted for and paid over, as aforesaid, except the sum aforesaid.


II. AND BE IT ENACTED, That whensoever any swine shall be taken up and secured by virtue of
this law, it shall be the duty of the patrolier to advertise the same at the court-house door, and at
each tavern in the town aforesaid, describing the marks and size of such swine, in order to ascer-
tain the owner or owners thereof; and in case the owner or owners of such swine shall not make
claim to such swine within the space of seven days thereafter, asd pay him the sum of two dollars,
if an inhabitant, or the sum of one dollar, if not an inhabitant, as the case may be, then the said
patrolier shall also dispose of the same at public sale to the highest bidder, and the money arising
from the sale thereof shall be paid over as aforesaid, except the sum aforesaid.

III. AND BE IT ENACTED, That if the patroller of said town shall neglect; or refuse to execute
any of the duties imposed on him by this act, he shall forfeit and pay to the overseer of the streets
aforesaid the sum of five dollars for each and every omission of his said duty, to be recovered by the
said overseer before any justice of the peace for Somerset county as other small debts are recover-
ed, and in case of such neglect or refusal by the said patroller to do the duties imposed on him by
this act, then it shall be the duty of the constable of said sown to execute such duties in the same
manner as the said patroller is authorised to do, and shall be allowed the same compensation for his
trouble, and shall forfeit the same penalty in case of neglect or refusal to act, to be paid and reco-
vered. as before directed by this act.

IV. AND BE IT ENACTED, That it shall and may be lawful for the said patroller or constable, as
the case may be, when any of the swine or hogs so taken up and confined shall be sold, or redeemed
by the owner, to receive and retain the further sum of six cents for each and every clay he shall
keep the said swine or hogs, to be paid out of the proceeds of any monies which may be produced
by said sale, or to be paid by the owner as aforesaid.

V. AND BE IT ENACTED, That all monies paid over and received by the overseer of the streets
aforesaid shall be applied by him towards repairing and keeping In order the streets of said town,

An ACT to authorise and empower Judith C. Moale and Thomas
Moale, of the city of Baltimore, to lease and demise the real estate
of Richard Halton Moale, deceased, for the purposes therein men-
tioned

January, 1803.

WHEREAS it Is represented to this general assembly, that Richard Halton Moale, of the city
of Baltimore, hath departed this life intestate, seized and possessed of sundry lots and par-
cels of ground in the said city, and also of a tract or parcel of land situate near the said city, called
Moale's Point; that if the said real estate was let out to tenants, on improveable leases, under an
annual ground-rent, the proceed thereof would support and maintain the widow arid three Infant
children
