have passed the said levy court, shall be lodged in the clerk's office of Baltimore county.

C H A P
LXXVII.

XV. AND BE IT ENACTED, That the commissioners of review, heretofore appointed, shall, at
the said sitting of the levy court next after the passage of this act, deliver to the said levy court,
all books, accounts and proceedings, relative to the said turnpike roads, and render, upon oath
or affirmation, a just and fair account of all the monies received by them, or paid to their order,
and also an account of all expenditures by them made as commissioners of review, and also ac-
count with the said levy court for all monies received, arid not by them expended, and pay the
same to the said levy court, or their order, and in case of neglect or refusal, the said levy court
are hereby authorised and required to commence a suit or suits for the recovery of the same.

XVI. AND BE IT ENACTED, That the supervisor appointed by the commissioners of review,
and acting as such at the commencement of this act, when thereto required by the levy court,
shall and he is hereby, directed to deliver over to the supervisor to be appointed in virtue of this

act, all the criminals that shall then be in his charge, or at labour on the turnpike roads of Balti-
more county, and also all waggons, carts, harness, geers, horses, oxen and mules, employed on
said turnpike roads, and belonging to the county, and also all provisions, provender of every kind,
tools, implements, arms, accoutrements, furniture, and all other articles and things furnished and
supplied by the said county for the use of the said roads, and the criminals working thereon, and
shall also render an account, on oath or affirmation, to the justices of the levy court, of all monies
by him received, and of all monies by him expended, within twelve months last past, and pay over
the monies in his hands to the justices of the levy court, and upon neglect or refusal to account
for and pay over the same, it shall and may be lawful for the justices of Baltimore county court,
upon motion of, and at the instance and in behalf of, the said levy court, to direct judgment to be
entered against such supervisor, and his securities, upon his bond by him and them given as afore-
said, for the penalty thereof, and cost, to be released upon the payment, of such money as shall be
by him due and owing, and the said court may thereupon award execution upon the said judge-
ments, provided the said supervisor, and his securities, or such of them as.it is moved for that
judgment shall be entered against, shall have had ten days notice previous to the term at , which
such motion shall be made, of the intention of the levy court .to move for such judgment.

XVII. AND, as a further fund to enable the said levy court to make the said roads, and to pay
all damages or value assessed therefor, and for the support of the criminals adjudged to labour on

said roads, and in making, cleaning and repairing, the streets and bason of Baltimore-town, BE
IT ENACTED, That the sum of fifty cents shall be and hereby, is laid and imposed for every hun-
dred pounds worth of property within Baltimore county, and in the same proportion for every
greater or less sum, and the said tax shall be paid and collected annually with the county tax, and
in the same manner, and the collector shall pay the amount of the said tax by him collected to
such person or persons as the said court shall appoint to receive the same, who shall from time to
time pay the same to their order, and the said tax shall continue until the said roads shall be made
and completed in the manner directed by this act; and the said levy court may, on the credit of
the said tax, borrow on interest, not exceeding six per cent, any sum of money they may think
proper and necessary, not exceeding the sum of sixteen hundred dollars in any one year, to make
and complete the said roads; and the said levy court shall, in every year, publish in the Balti-
more news-papers an account of the said money by them received and expended in virtue of this

XVIII. AND BE IT ENACTED, That any toll to be collected on any of the roads aforesaid shall
belong to Baltimore county, and shall be collected and applied to the use of said county for ever,
the said county maintaining and repairing the said roads in the order and condition directed, and
required by this act.

XIX. AND BE IT ENACTED, That any waggon, cart or other carriage, leaden or unloaden,
having the felloes of the wheels thereof of six inches from side to side at the least, (the tread or
bottom of such felloes to be as flat and even from side to side as may be,) may pass any turnpike
gate on paying only one half the tolls hereby imposed for five years from the passing of this act.

XX. AND BE IT ENACTED, That if any person shall drive any black cattle, sheep or hogs, or
any riding carriage, waggon, cart or other carriage of burthen, round any toll gate, with intention
to evade the payment of the toll, and if any person shall ride, lead or drive, any horse or mule
