CHAP. XVII.

Passed 31st of
Dec, 180.1.

A Supplement to an act, entitled, An act to establish and regulate
a market in Charles-town, in Charles county, and to prevent
persons from suffering goats, hogs and .geese, to go at large in
the said town.

No goat, Sec.
to go at large,
&c.

BE IT ENACTED, by the General Assembly of Maryland, That from and after the first day of April
next, no goat, hog or goose, belonging to any inhabitant of the said town, shall be suffered
to go at large in Charles-town, in Charles county; and if any person shall find any goat, hog or
goose, going at large in Charles-town aforesaid, it shall and may be lawful for such person to kill,
or cause to be killed, such goat, hog or goose.

General issue
pleadable.

II. AND BE IT ENACTED, That if any person shall be sued for killing any goat, hog or goose,
in Charles-town aforesaid, such person may plead the general issue, and give this act and the spe-
cial matter in evidence

Section repeal-
ed.

III. AND BE IT ENACTED, That the tenth section of the act to which this is a supplement be
and the same is hereby repealed,

C H A P. XVIII.

Preamble.

AN ACT to open a road in Saint-Mary's county.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants
of Saint-Mary's county, residing in the neighbourhood of Saint-Joseph's church, that they
experience great inconvenience for the want of a public road from the land of colonel Henry
Neale to the aforesaid church ; therefore,

A road to be
laid out, &c.

II. BE IT ENACTED, by the General Assembly of Maryland, That John McWilliams, Richard Mel-
ton, James Cook, Jeremiah Alvey and Elisha Johnson, be and they are hereby authorised to lay
out and open a road from the land of colonel Henry Neale, of Saint-Mary's county, in the most
convenient direction, through the land of John Tippitt, Richard Milton, Benedict A. Price, James
Cook and Edward B. Goddard, to intersect the main road from Chaptico to Saint-Joseph's church ;
and the said commissioners are hereby empowered to contract with the proprietor or proprietors of
the land over which the road may pass, and in case they cannot agree, then and in that ease the
commissioners, or a majority of them, shall forthwith issue a warrant, under their hands, directed
to the sheriff of the said county, commanding him to summon twelve good and lawful men of the
county, not interested in the land, or connected with the parties, to be and appear on the pre-
mises, on a certain day by him to be appointed; and in case the number of twelve shall not attend,
the said sheriff shall summon other persons, qualified as aforesaid, until that number do attend ;
and the said sheriff shall then and there empannel the jury, and administer to them the following
oath or affirmation, as the case may be, to wit: " I, A. B. do swear, that I will well and truly,
" without favour, affection, prejudice or partiality, ascertain the damages that will be sustained by
" the proprietor or proprietors of the land in consequence the passage of a road laid out in vir-
" tue of this act, according to the best of my judgment; so help me God;" and the contracts by
the commissioners, or inquisition of the jury, as the case may be, shall be returned to the clerk of
the county court, to be there recorded, and on the payment of the sum or sums of money con-
tracted for or ascertained as aforesaid, the proprietor or proprietors through whose land the said
road shall pass, and upon payment, or tender of such damages, by any person or persons, to the
proprietor or proprietors aforesaid, the said road shall be recorded among the records of Saint-
Mary's county court, and be hereafter deemed and taken to be a public road for ever, and shall be
kept in repair in the same manner as other public roads are directed to be kept in the said county j
provided, that the said road shall not go through any houses, gardens, yards, meadows or orchards/
unless with the consent of the owner thereof.

CHAP. XIX.

Passed 31st of
Dec. 1801.

A Supplement to an ad, entitled, An ad for the relief of Joseph
Forman.

May retain his
apparel, &c.

BE IT ENACTED, by the General Assembly of Maryland, That the chancellor is hereby authorised
to allow the said Joseph Forman to retain the necessary wearing apparel and bedding of him-
self and his family,
