901 Command was given to the sheerif of Kent County the 23.th day of March 1697/8 that he take Thomas Scotton if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the next Court to Answer unto James Mittchel of old England Ma.rin.r of a plea that he rend.r unto him 618.ll of Tobaccoe Att which Court viz the 26.th day of April Anno Dom 1698 the day of returne of sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and made returne of sd Writt in these words Cepi p Edw Sweatnam sheft And now here att this day the sd cause standing for Tryal the Defend.t being served with a Coppy of the Declr according to an Act of Assembly in that case made and provided & the sd Plt by Richard Macklin his Att.ry declareth viz Kent fs Thomas Scotton otherwise called Thomas Scotton of sd County Planter was summoned to Answer unto James Mitchel of London of ould England Marin.r of a plea that he render unto him the full and just sume of six hundred and Eighteen poundes of Tobaccoe cleare of ^all manner of Trash &^ ground leaves and seasoned caske which to him he Oweth and from him he unjustly deteineth And Whereupon the sd James Mitchell by Richard Macklin his Att.ry saith that Whereas the sd Thomas Scotton on the 25.th day of March Anno Dom 1697 att Chester River in sd County within the Jurisdicon of this Court by his certain Bill or Writing obligatory sealed with his seale as his Act and deed delivered and here into Court brought whose date is the same day and Yeare ^did^ bind himselfe his Heires Ex.rs Adm.rs and Assignes to pay or cause to be well and truely paid unto the sd James Mitchel his Heires Adm.rs or Assignes or to his Lawfull Att.ry the aforesd sume |
