And the sd Plt by Richard Macklin his Att.ry informeing
this Court that this was the second Writt on which the
sheerif had made the same Returne moves this Court
for an Attachm.t which was Accordingly granted

Therfore it is considered by this Court that the
the plt Coll John Hynson have Attachm.t ag.t the Estate
of Sam.l Withers for the sume of One Thowsand and
Nineteene poundes of Tobaccoe as allsoe the sume
of

Command was given to the sheerif of Kent County the
18.th day of Feb.ry Anno Dom 1697 that by good and Lawfull
men of his Bailiwick he make Known unto James
Benson Ex.r of Sam.l Withers if he should be found in his
Bailiwick soe that he be &c.a before his Maj.ties Justices att
the next Court to shew cause &c.a why Execucon should
not Issue ag.t him for the sume of Four Thowsand One hundred
Ninety and Two poundes of Tob recovered p Rennatus Smith

Att which Court viz the 26.th day of April Anno Dom 1698
the day by Adjournm.t of returne of sd Writt came Capt
Edward Sweatnam high sheriff of sd County and made returne
of said Writt in these words viz Nihi p Edw Sweatnam
sheeft

And the sd Plt by Richd Macklin his Attorney informeing this
Court that this was the second Writt on which the sheerif had
made the same returne moves this Court for an Attachm.t
which was accordingly granted

Smith have Attachm.t ag.t the Estate of Sam.l Withers for the
