895 Ordered by this Court that processe Issue out ag.t those pson psons that are presented and Indicted who shall not now appeare according to their several venires allready Issued S Wilmer Clk Grand Jury are Allowed Three hundred poundes of Tob and are discharged John Hambleton being by this Court Appended Constable of the Towne Hundred Takes the Oathes of Alleigance & abhorrency and is sworne Constable Command was given to the sheerif of Kent County the 18.th day of Feb.ry Anno Dom 1697 that by good and Lawfull men of his Bailiwick he make Knowne unto James Benson Ex.r of Sam.l Withers if he should be found in his Bailiwick soe that he be and appeare before his Maj.ties Justices att the Next Court to shew cause &c.a why Execucon should not &c.a for the sume of 691.ll of Tobaccoe due to Simon Wilmer for clerk Fees Att which Court viz the 26.th day of April Anno Dom 1698 the day (by Adjournm.t) of returne of sd Writt came Capt Edward Sweatnam high sheerif of sd County and made returne of sd Writt in these Wordes viz Nihil p Edw Sweatnam sheft And the sd Plt by Richard Macklin his Att.ry makeing it appeare that this was the Second Writt on which the sheft had made y.e same returne moves this Court for an Attachm.t w.ch was Accordingly granted Therfore it is considered by this Court that the Plt Simon Wilmer have Attachm.t ag.t the Estate of Sam.l Withers as well for the aforesd sume of Six hundred Ninety and Two poundes of Tobaccoe debt as allsoe y.e sume of S Wilmer Clk |
