Wherupon the sd Defend.t moves this Court for a Non
suit which is accordingly granted

Therfore it is considered by this Court that the Defd.t
Robert Davenish doe Recover from the Defend.t Richard
Wallis as well the sume of Fifty poundes of Tobaccoe for
a Non suit as allsoe the sume of Two hundred and Twelve
