819 Command was given to the sheerif of Kent County the 26.th day of June Anno Dom 1697 that he Take John Hollingsworth if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the Next Court to Answer unto John Hawkins of a plea of Tres upon y.e case Att which Court viz the 24.th day of August Anno Dom 1697 the day of Returne of sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and made returne of sd Writt in these wordes viz Cepi p Edw Sweatnam sheft On which sd day the sd Defend.t by W.m Hemsley his Att.ry appeares and prayes therof to Imparle until next Court which was granted the same day is given to the Plt likewise Which said cause being continued from Court to Court until this present day And now here att this day viz the 24.th day of November Anno Dom 1697 the said Cause standing for Tryal came the sd Plt by Sam.ll Withers his Attorney and declares ag.t the sd Defd.t viz
And whereupon the said John Hawkins by Sam.ll Withers his Att.ry complaineth that Whereas the said John Hollingsworth y.e 19.th day of February Anno Dom 1694 att Chester River within the Jurisdicon of this Court by his certain Writing subscribed with his hand as his Act and deed delivered and here unto Court brought whose date is the same day and Yeare aforesaid he did promise to pay unto the sd John Hawkins by the order of one Jn.o Salter the sume of One Thowsand Five hundred Sixty and Five poundes of Tobaccoe and in consideracon therof the sd John Hollingsworth |
