Tres sur Case continued

Command was given to the sheerif of Kent County the 25.th day
of June Anno Dom 1697 that he Take Thomas Joce if he should
be found in his Bailiwick and him safe Keepe soe that he have
his Body before his Maj.ties Justices att the Next Court to Answer
unto William Bently of a plea of Trespasse upon the case

Att which Court viz the 24.th day of August Anno Dom 1697
the day of returne of sd Writt came Cap.t Edward Sweatnam
high sheerif of sd County and made returne of sd Writt in these
Words viz Cepi Corpus p Edw Sweatnam sheft

On which day came the sd Defend.t by Michael Earle his Attorney
and prayes therof to Imparle until the Next Court which was granted
the same day is given to the Plt likewise

And Now here att this day viz the 28.th day September Anno
Dom 1697 the sd cause standing for Tryal but the plt not haveing
filed his Declaracon the Defend.t Thomas Joce for Michael Earle his
Attorney moves this Court for a Non suit which is Accordingly Granted

Therfore it is considered by this Court that the Defend.t Thomas
Joce Doe Recover from the Plt William Bently as well the sume
of Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of
One hundred Fifty and Eight poundes of Tobaccoe cost of suit

day of June Anno Dom 1697 that he take Elias Robinson if
he should be found in his Bailiwick and him safe Keepe soe
that he have his Body before his Maj.ties Justices att the Next
Court to Answer unto James Frisby Esq of a plea that he
render him the full and just sume of Nine hundred Sixty &
and Eight poundes of Tobaccoe &c.a

Att which Court viz the 24.th day of August the day of returne of
sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and
made returne of said Writt in the sd Words viz Cepi p Edw Sweatnam
