Command was Given to the sheerif of Kent County the 30.th
day of October Anno Dom 1696 to take William Scott M.rcht
if he should be found in his Bailiwick and him safe Keepe
soe that he have his Body before his Maj.ties Justices att the Next
Court to Answer unto Joseph Lambert in a plea of Trespasse
upon the case

Att which Court viz on the 24.th day of November the day
of returne of the said Writt came Capt Edward Sweatnam
high sheerif of said County and made returne of the said Writt
in these following wordes viz Cepi Corpus Edw Sweatnam

To which the said William Scott by Griffith Jones his Attorney
appeared and Imparles until next Court which was granted
& the same day is given to the Plt likewise

And now here att this day came the said Joseph Lambart by
William Hemsley his Attorney and declares ag.t the Defend.t viz

Kent fs  William Scott of Kent County M.rcht standes Attached to
Answer unto Joseph Lambart of a plea of Trespasse upon the case

And wherupon the said Joseph Lambart by W.m Hemsley his Att.rny
complains that whereas the said William Scott on the 20.th day of
August Anno Dom 1696 att Chester River in said County within y.e
Jurisdicon of this Court in consideration and att the Especial
instance and request of him the said W.m Scott that if he the
said Joseph would lend to him the said W.m One sadle horse to performe
a certain Jorney which he the said William was att that
time to undertake that then he the said Wm Scott would returne
to him the said Joseph in as good condicon and as sound as when
received and the said Joseph in fact saith that he trusting to the
promise and Assumption aforesaid of him the said W.m Scott did lend
to him the said William Scott One good sadle horse Wind and limb
of the value of 3000.ll of Tobaccoe to performe his Jorney aforesd
Yett Neverthelesse the said William Scot his promise and Assumption
aforesaid little regarding but plotting contriveing and fraudulently
intending him the said Joseph in this behalfe craftily
