This Indenture made y.e third Day of y.e [illegible] month 1684
& in y.e ninth yeare of y.e Dominyon of Charles Absolute L.d & propriatory of the province
of Maryland & Avalon Lord Barron of Baltimore before John Barnes
& Elizabeth his wife & y.e one party And Cornelius Comegyes Jun.r of y.e other party and
of y.e County of Kent in y.e aboves.d Province of Maryland Wittnesseth y.e s.d John
Barnes w.th y.e Consentz of his wife Elizabeth for and Consideration of three thousand pounds
of tobacco to them in hand all Ready before the Sealing and Delivering hereof to y.e s.d Cornelius
Comegyes Jun.r y.e Receip.t whereof he y.e s.d John Barnes & Elizabeth his wife Doth hereby
acknowledg And for every partt & parcell thereof Doth hereby absolutely and [illegible]
exonerate acquitt and Discharge The s.d Cornelius Comegyes his heirs executors
administrators or assignes And by these p.rsents have given granted bargained
Alianated and Sould enfeofed & Confirmed unto him y.e s.d Cornelius Comegyes his heirs
or assignes for ever A parcell of Land Caulled [illegible] Laying in Kent County
& on the North Side of Chester River begining at A marked Red oak standing
neare y.e river side on A Clift from w.ch oake runing north three hundred and twenty
pearches & from y.e end of y.e north line with a line Drawne West Fivety Pearches &
from y.e one of y.e west line with a line Drawne south three hundred & Twenty pearches
and from y.e end of y.e south line with a line Drawne east Fivety Pearches to y.e first
bounded Red oake it being one hundred acres of Land more or less taken out of a tract
of one hundred & Fivety acres And is adjoyning to a parsell of Land formerly taken on
by Thomas Morris Deceased Called by y.e name of Presbury To have & to hold
y.e s.d Land for ever togather w.th all wayes Eastments Privildges to the sume belonging or
appertainiing togather w.th all writtings Deeds Charters Dividends touching or Conserning
every Partt or parsell thereof To have & to hold y.e s.d percell of Land attending to y.e
bounds [illegible] I togather w.th all Meadows Feedings pastures wood & freewoods water
courses Fishings Fenceings wayes proffits houses fencis profits Comodities Comon of pasture
heriditaments whatsoever or belonging or appertaining to y.e s.d Land it being lately in y.e
[illegible] or on pation of y.e s.d John Barnes and also all the estate Right title and intrest
use [illegible] property Claime and [illegible] whatsoever of them y.e s.d John Barnes Elizabeth
his wife of in and to y.e same with all writting and all Deeds evidence Charters transcripts
fines pattents Courtt houses scripts & Numinent Whatsoever touching and enjoyning
y.e p.rmises or any partt or parcell thereof To have and to hold and shall and will [illegible]
make warrant & Defend by these p.rsents & y.e s.d John Barnes & Elizabeth his wife at
y.e time of sealing & Delivery hereof of these p.rsents is and standeth untill a good and paie
perfect and absolute estate of inheritance of all and singuler y.e before grantted p.rmissee
and every partt thereof shall be fully vested settled and executted in and upon y.e s.d Cornelius
Comegyes and his heirs according to the true intent and meaning of these p.rmises shall
[illegible] and be seazed of and in y.e s.d Land and all & singuler other the p.rmises
and in and by these p.rsents granted bargained and sould with all & every their Rights
members and apperttinances of a good perfectte and absolute estate of inheritance
in Fee simple without any Condition or Limitation of any use or uses: estate of estates
in or to any person or persons whatsoever to alter Change Defect or Determine
or make voyd y.e same and that y.e s.d John Barnes and Elizabeth his wife at the
time of sealing and Delivering of these presents hath Full Power good Right &
lawfull Authority to grant bargaine sell And Convey all and singuler y.e before hereby
or mentioned to be granted p.rmises with their & every of their Rights and appertinances
unto y.e s.d Cornelius Comegyes his heirs or assignes in manner and forme afores.d and that he
y.e s.d Cornelius Comegyes his heirs and assigns and every of them shall and maye by
force & vertue of these p.rmises from time to time and at all times for ever hereafter
lawfully and peaceably and quietly have hold and Occupie and posess and injoy y.e
s.d land: and all and singuler the before grantted p.rmises: with their and
