Therfore it is considered by this Court that the defend.t Walter Smith doe recover from the plt Coll Peter Sayer the sume of Fifty poundes of Tobaccoe for a Non suit & cost Simon Wilmer Clk
Kent fs Robert Davenish of the County aforesaid stands attached to answer unto Thomas Steevens of the said County of a plea of Trespass upon the case Whereupon the said Thomas by Charles Bast his Att.ry complaineth and saith that the said Robert stands justly indebted to him in the full and just sume of Three hundred and seaventy poundes of Tobaccoe for several goods & wares to him sould and delivered as p a perticuler accompt therof in Court ready to be produced may more att large appeare in consideration wherof the said Robert did faithfully promise and upon him also did assume the same to pay and satisfie when he should be therunto required Yet nevertheless the said Robert the aforesaid sume of 370.ll Tob alltho often therunto required hath not paid but the same to pay hath hitherto denied and still doth denie and refuse wherupon the said Thomas saith he is damnified 740.ll Tob and therupon he brings this suit Bast p Quret pce John Doe Rich Roe |
