VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1806. 91

Mr. Kuhn, from the committee, delivers to the speaker the following report:

THE committee to whom was referred the petition of sundry inhabitants of Frederick and Washington coun-
ties, praying that a law may pass authorising them to open a road in said counties, report, that they have taken
the same into consideration, and are of opinion that the prayer thereof is reasonable, but in as much as it does
not appear to your committee that public notice had been given of their intention to petition this legislature for
the passage of such a law, their prayer cannot be granted at the present session, and that the petitioners have
leave to withdraw their said petition.

By order, L. GASSAWAY, clk.
Which. was read the first and second time by especial order and concurred with.

On. the second reading of the supplement to an act, entitled, An act to establish permanent salaries for the
judges of the six judicial districts in this state, the question was put, That the blank be filled up with the word
" eight hundred?" Determined in the negative.

The question was then put on " three hundred. " Determined in the negative.

The question was then put, That the further consideration thereof be referred to the next general assembly?
Resolved in the affirmative,

On the second reading of the resolution investing money in the Farmers Bank of Maryland, the question was
put, That the blank therein be filled up with the words " sixteen hundred?" Resolved in the affirmative.

The question was then put. That the house assent to the resolution? Resolved in the affirmative.

The following resolution was read the first and second time by especial order, assented lo, and sent to the
senate by the clerk,

RESOLVED, That the treasurer of the western shore be and he is hereby authorised and required to pay unto
John Brewer, clerk of the hous: of delegates, the sum of forty dollars, in addition to his allowance for arranging
in alphabetical order the old papers in the committee room.

Mr. Pearce, from the committee, delivers to the speaker the following report:

THE committee to whom was referred the petition of Jasper E. Tilley, late sheriff of Anne-Arundel county,
report, that they have taken the same into consideration, and are of opinion that full and ample provision is
already afforded to the petitioner to complete his collections as sheriff aforesaid, on his complying with the re-
quisites and provisions of the act of November session, seventeen hundred and eighty-eight, chapter thirty-one,
entitled, An act enlarging the time for collection of officers fees by execution. The committee are also of opi-
nion, that the petitioner ought not to be exempted or relieved from the performance of the duties prescribed by
the provision of that act, that his prayer is unreasonable and ought not to be granted, and that he have leave
to withdraw his said petition.

Which was read the first and second time by especial order and concurred with.

On motion, Leave given to bring in a bill, entitled, An act for the payment of the journal of accounts. OR-
DERED, That Mr. Hawkins, Mr. Shaaff and Mr. M'Pherson, be a committee to prepare and bring in the same.

Mr. Hawkins, from the committee, delivers the said bill; which was read the first and second lime by especial
order, passed, and sent to the senate by the clerk.

Mr. Hawkins, from the committee of claims, delivers to the speaker the journal of accounts; which was read
and assented to, and sent to the senate by the clerk.

The resolution relative to the address to the president, was read the second time by especial order, and the
question put, That the house assent to the same? The yeas and nays being required, appeared as follow:

So it was resolved in the affirmative.

The bill to prevent swine and geese from going at large in Frederick-town in Caecil county, and the bill to
prevent swine from going at large in North Sassafras, West Sassafras and Bohemia Hundreds, in Caecil county,
were read the second time, passed, and sent to the senate by the clerk.

The clerk of the senate delivers the following messages:

By the S E N A T ET January 3, 1807.
Gentlemen of the House of Delegates,

THE bill, entitled, An act for the encouragement of learning in this state, originated in your house, has,
after the most serious consideration, received our negative. By this bill, as passed your house, more than the
sum of 30, 000 dollars is appropriated to be paid annually out of money in the treasury, by which provision no
doubt can be entertained that it is within the meaning of the constitution a money bill, and being such, the
senate are constitutionally precluded from all alteration and amendment. To this bill, from which you have
