VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1806. 79

Whereas it is of importance to every republican government to encourage, by every means in its power, the

enterprising and patriotic exertions of its citizens in defence of their country: And whereas George Washing-
ton Mann, a citizen of this state, in conjunction with ———————— O'Bannon, was the first to establish the
American standard, under the command of general Eaton, on the walls of Derne, thereby signalizing himself
for his bravery, and contributing to the delivery of many of our fellow-citizens from bondage; therefore RE-
SOLVED That the governor and council be and they are hereby authorised and required, to procure a handsome
sword, with an appropriate engraving and motto, emblematic of the action of Derne, and cause the same to he
delivered to the said George W. Mann, in testimony of the high sense of approbation the legislature of this

state entertain of his gallant conduct.

The report of the committee of conference respecting the situation of the government property appropriated
to the use of the governor, was read the second time and the resolutions therein contained assented to.

The following order was read.

ORDERED, That the committee cf claims allow on the journal of accounts the sum of twenty-five dollars to
each of the committee clerks, as a further compensation in addition to their per diem, and place the same on.
the journal of accounts.

And the question was put, That the house assent to the same? Determined in the negative.

On motion, Leave given to bring in a bill, entitled, A supplement to an act, entitled, An act respecting the
acknowledgment of deeds. ORDERED, That Mr. Smoot, Mr. Shaaff and Mr. Ward, be a committee to prepare
and bring in the same.

The bill annulling the marriage of Sally Lutig, of the city of Baltimore, was read the second time, and the

Question. put, Shall the said bill pass? Determined in the negative.
The house adjourns until to-morrow morning 9 o'clock.

WEDNESDAY, December 31, 1806.

THE house met. Present the same members as on yesterday. Th proceedings of yesterday were read.

The resolution relative to the government property was sent to the senate by the clerk.

On motion, Leave given to bring in a bill, entitled, An act relative to magistrate's fees. ORDERED, That
Mr. Denny, Mr. Dickinson and Mr. Moffit, be a committee to prepare and bring in the same.

On motion, the question was put, That the house reconsider the bill annulling the marriage of Sally Lutig
and John C. Lutig? Resolved in the affirmative.

The bill being read throughout, the question was put, Shall the said bill pass? Resolved in the affirmative;
which was sent to the senate by the clerk.

Mr. Smoot, from the committee, delivers to the speaker a bill, entitled, A supplement to an act, entitled, An
act respecting the acknowledgment of deeds; which was read the first time and ordered to lie on the table.

On the second reading of the bill to prevent duelling, the question was put, That the further consideration

thereof be referred to the first day of Jun? next? Resolved in the affirmative.

The engrossed bills from No. 1 to No. 30, inclusive, were read and assented to, and, with the paper bills
thereof, sent to the senate by the clerk.

Mr. Denny, from the committee, delivers to the speaker a bill, entitled, An act relative to magistrate's fees;

which was read the first time and ordered to lie on the table.

The bill for the relief of the sheriffs of the several counties of this state, was read the second time, and the
question put, Shall the said bill pass? The yeas and nays being required, appeared as follow:

On the second reading of the resolution relative to the Baltimore and Frederick town turnpike road, and Bal-
timore and Reister's-town turnpike road, the question was put, That the first blank therein be filled up with
the words " nine hundred?" Determined in the negative.

The question was then put on " six hundred. " Determined in the negative.

The question was then put. That the further consideration of the resolution be referred to the next general-
assembly? Resolved in the affirmative.

The message proposing to rise on Saturday nest was read the second time, agreed to, and sent to the senate
by the clerk.
